I believe the contention is that the transfer of 16 year olds with EU passports is only permissible between clubs within the EU or if the individual concerned is living in the EU. Velez are arguing that Garre was doing neither and that his parents flew to Germany the day before their sons 16th birthday before signing for City 2 days later. The fact that FIFA may have erred in their decision making process may or may not impact on who gets punished
