It's a ban, 2 matches is sufficient usually, but his mentality was "I've missed, I'll make sure I get him a second time" so that's intent to harm/injure hence why I expect 3 matches.
The law states: "Violent conduct is when a player uses or attempts to use excessive force or brutality against an opponent when not challenging for the ball, or against a team-mate, team official, match official, spectator or any other person, regardless of whether contact is made."
The fact that Lumpkaku couldn't hit a cows arse with banjo shouldn't protect him from a ban just because he didn't make contact. The clear intent was to kick the defender; twice.
The FArce have been known to take an interpretive view of the Laws of the Game, and apply them unequally to various teams, so the Lump could still get away with it.
The biggest annoyance for me was that the BBC (and others) chose to ignore it, not just on MOTD, but MOTD2 where they completely omitted their usual 2 Good - 2 Bad feature because "all of the action over the weekend was pretty average" - Likely that they didn't want to highlight any naughtiness from a certain Belgian lump. It wasn't in their online match report, nor Twitter/FB, etc. It was just blatantly obvious they were attempting to either cover up for the Rag's, or carry favour with them. Funny how the Derby is only 3 games away........
When Sergio didn't elbowed Winston Reid in the throat they were all over it like a rash from multiple camera angles both during the game and in the post match analysis. It was also in their online post match report, Twitter feed, Facebook page, and various pundits were discussing it on radio and TV news reports, just to ensure that Sergio would get a ban from the FA prior to the Derby.

Yes, you are right; it was debatable. All the replays showed "probable" intent but no real contact. The Lump was "CLEAR" intent with some contact, no matter how minor.*Edit* that's better...

He should be banned. Just read on sky sports that a former referee has claimed he won’t be banned as it wasn’t an act of violence. Get fucked. Sergio got crucified for elbowing Reid last season. Say what you want about lukaku, he’s dangerous and he always seems to score against us.

Why are the fixtures for the christmas period so favourable for man city? It looks like the whole fixtures were tailor made in the best possible way for them. That is really annoying
