Well, presumably the bank refunded the money spent on their stolen debit card, so strictly speaking it's the bank that ought to get the money to reflect the financial loss.

The card holder? (It was their money)
The bank ( Just because they refunded money, does that mean they get to keep any recovered property?)

Well I'd have thought we can't have it both ways here - expecting the bank to refund losses when someone uses a card fraudulently, but then claim winnings from money that hasn't been lost in the first place.

Isn't the bank insured for losses?

I'd say that the ticket is the property of the bank once monies were refunded.

Timing is everything. If the ticket came up before the refund then the card holder will be quids in.
 
I would say the ticket has been obtained by illegal means and is therefore void. But I'm just making stuff up like everyone else.

P.S, if the criminals that bought the ticket had half a brain between them they would have offered the cardholder 2 mil to play along.

i'm sure a good brief could turn this around ''John' has vanished into the scotch mist but i'm sure he could say he gave them permission to buy him the ticket and due to a bad memory he forgot to mention it then there is no fraud
 
Apparently the idiots who 'won' are going to call the cops and report Camelot for not paying out ! One of them was recently on a 'most wanted' list. The cops are really going to pull out all the stops for them and insist Camelot give them the money.

One of the simpletons is a rag, so I hope they get 10 years for fraud. The funniest thing about it is, they've been on a huge bender in London spending god knows how much( probably borrowed a few quid on the strength of it) and now the cretins will have to pay that back. :) Karma.

The national lottery own the ticket..To pass title on a sale, there has to be "a bona fide third party purchaser for value". The robbers were not bona fide and thus no title is passed. Assuming the actual ticket belongs to the lottery before any sale, the lottery still own it after a fraudulent sale.(That will be £4000, please, made payable to Sue Grabbit and Run)
