So, are you saying that if someone appeals to CAS and UEFA had correctly applied their procedures, CAS would not be able to review anything in support of the clubs claim that UEFA were wrong about anything?

In a nutshell yes. If you look at a few cases you can see the trend and not just with UEFA.

CAS either throw out cases due to due process/procedures not being followed in the investigation or the reduce the ban/fine as they deem it excessive.

Im not sure about other sporting organisations but I know one of UEFA’s stipulations and something we would have signed up to is we cannot take any grievance any further than CAS. They are suppose to be the final recourse.

Of course I’m not sure that would stand up in any court of law and I’m sure City don’t give a fuck and will go to the Swiss Courts anyway but it is something to be aware of.

As PB has already stated CAS are not a court as such. They will only rule on procedural violations and make sure the punishments UEFA sanctioned fit the crime as such.

The best we can hope for at CAS is the case is thrown out due to UEFA not following its own process.

That is the reason City mentioned “CAS in the first instance” The fight to clear our name and show the irrefutable evidence will happen in the Swiss Courts
Not according to their own code, the "The Panel has full power to review the facts and the law."

I cant deny that all this has upset me quite a bit last few days.
I lost my dad last year and still struggling to come to terms with it. He took me to Maine road and we had some good times.
I think we will get cleared but with VAR and the constant attacks on our club are making me contemplate not renewing and giving up on the game completely.
Maybe that was the authorities plan all along, I'm not sure anymore.
I know how you feel mate but we need to turn up tomorrow and be loud and proud we’re needed more than ever now!

What if the cartel clubs actually want us to destroy UEFA so they can form their breakaway European league and make out it was our fault. Conspiracies R Us
That’s what I’ve been thinking.

Are they playing us and UEFA good and proper?

Not sure if posted earlier re the article in the guardian today.

They are basically reporting on Etihad airlines and leaked emails etc. In a nutshell Etihad state that our sponsorship deal is paid by them and shown in their accounts. The furore regarding the ADUG pay most of the delay is wrong. They lost over 3 billion and said they drew down on a loan provided by ADUG which works similar to a overdraft which most large companies have access to via banks or investors.

So yes ADUG did find the money but it wasn’t specifically for city and their accounts apparently show £160 plus million spent on sponsorship in that year.

i would hazard a guess and say emirates operate in a similar manner.

As said in previous posts Bayern are sponsored by Audi to the tune of £60 mill plus And they are directly owned by VW who also have a stake in the club! Go figure huh
Are you absolutely, 100%, gun-to-your-head sure you're talking about ADUG?

Most leagues under the aegis of UEFA are already uncompetitive, even the big ones France, Germany, Italy, Spain. CL money and ffp keep the non elite out. Liverpool last year got 50% of the entire solidarity money for the whole of Europe. For the smaller countries, it is even worse, because they only get one CL place, if they are lucky. Yet Uefa boast that there is less debt and more profit in European clubs.
Joke.
It's shocking when you think that those leagues in Germany and Italy used to be competitive and great to watch. UEFA has done everything it can to preserve the status of Bayern and Juve. The bizarre thing in Germany is that most fans hate Bayern but they hate the new money clubs like Leipzig and Wolfsburg even more. If one of the new clubs could hole Bayern under the water (like we did to the Rags) it would open the door for lots of other contenders. Football fans are their own worst enemies sometimes. We should really form an allliance with Chelsea to take on the establishment here but it will never happen. Imagine if the progressive clubs with money like us, Chelsea, Everton, Wolves perhaps joined forces to force change.

You're thankfully mistaken on this.

R57 Scope of Panel’s Review, Hearing

The Panel has full power to review the facts and the law. It may issue a new decision which replaces the decision challenged or annul the decision and refer the case back to the previous instance. The President of the Panel may request communication of the file of the federation, association or sports-related body, whose decision is the subject of the appeal. Upon transfer of the CAS file to the Panel, the President of the Panel shall issue directions in connection with the hearing for the examination of the parties, the witnesses and the experts, as well as for the oral arguments.

After consulting the parties, the Panel may, if it deems itself to be sufficiently well informed, decide not to hold a hearing. At the hearing, the proceedings take place in camera, unless the parties agree otherwise. At the request of a physical person who is party to the proceedings, a public hearing should be held if the matter is of a disciplinary nature. Such request may however be denied in the interest of morals, public order, national security, where the interests of minors or the protection of the private life of the parties so require, where publicity would prejudice the interests of justice, where the proceedings are exclusively related to questions of law or where a hearing held in first instance was already public.

The Panel has discretion to exclude evidence presented by the parties if it was available to them or could reasonably have been discovered by them before the challenged decision was rendered. Articles R44.2 and R44.3 shall also apply.

If any of the parties, or any of its witnesses, having been duly summoned, fails to appear, the Panel may nevertheless proceed with the hearing and render an award.
