Let us all just wait and see what CAS has to say. I don't think that CAS will be that stupid as to allow leaks to come from them.

What I do expect is that both Man. City and UEFA will get the verdict before it is released to the media. Maybe the day before and be told to keep it under raps
 
CAS won't leak. But both parties will have a good feel for how it went. Less so than a full hearing in person but the receptiveness, questions, scepticism and tone of the panel will give the lawyers, in particular, a good feel for where the mind of the panel will land. We are unlikely to see that reflected in any actions from UEFA (except perhaps some bland briefings (unlikely)) but it will be harder for City's exec team not to show their confidence or otherwise in the next 4 weeks.

At last, a summary of the procedure I can understand. Let's hope it goes two plan.

I have high confidence that a) they won't be buying any big money players before they KNOW the decision b) if they do buy any big money players before we KNOW the decision, they KNOW they have won (ie will have certainty not just confidence).

Statement of the obvious perhaps but I don't expect any buys before the decision is announced.
 
Yes, that's my view. It's an anodyne statement that people are reading into too much, however, it does emphasise that City have had the fair hearing that their February statement said they were denied by UEFA. Put it this way - the hearing would not have been concluded until both sides were able to confirm that they were happy with how it was conducted.

This will be an exceptionally busy few weeks for the three arbitrators. They not only have to make a decision but they then have to promulgate an appeal determination addressing all of the facts and evidence presented to them. When you consider that the determination for CAS 1 was 40 pages long just to say that we hadn't exhausted all avenues of redress with UEFA, this time we're in for some hefty bedtime reading packed with complex legal jargon.

If things go as well as we all hope they do, the arbitrators will be having a conference call today saying "how on Earth did UEFA even allow this to come to us?" According to Martin Samuel, UEFA are the most frequent visitors to CAS. When you consider that the IOC (responsible for thousands of individual athletes in a variety of disciplines) falls under the CAS remit, this is a very poor reflection on UEFA's corporate governance model. It's highly embarrassing, in fact. He may not be popular, but Dominic Cummings once remarked to the effect that when you first enter Westminster, you wait for a door to open where you find all the intelligent people but it never materialises. He could easily have been describing UEFA.

I also think that the statement about fairness is relevant to the leaks issue. CAS may be saying in effect that the leaks issue is no longer an issue because any effect the leaks had on the previous due process has been remedied by the fairness of the CAS hearing. So I'm personally not expecting the leaks issue to have a bearing on the CAS decision and that the written decision will say this and explain why.

That said however it shouldn't be forgotten that CAS are an arbitration body and they may well take the view that the leaks and the resultant acrimonious correspondence between MCFC and UEFA led to a total and utter breakdown between the parties which rendered any scope for resolution impossible and possibly even led to UEFA petulantly handing out a penalty more severe than they would have otherwise. That's entirely speculation based on the belief that an arbitration body's instincts are to arbitrate and I'd be very surprised if CAS didn't explore the scope for compromise if they thought it worthwhile.

Please don't jump up and down and say that City's position is no compromise and we shouldn't countenance that. We know that but City will have to be guided by their legal team and if the case has not gone as well as they would have wanted then the subject of compromise may well arise. And if you don't believe that then ask yourself how many times you've gone to a match we were nailed on to win, found ourselves 1-0 down with 10 minutes to go and thought "I'd take a draw right now".
