I really hope the club weren't guided by what the fans want!!! The notion that we are going to take down UEFA, the G14 & any other perceived enemies through the courts is wildly optimistic.

I don't think the Club would have been guided by the fans but it might have been one of a number of factors considered. It's more likely that our Directors felt that UEFA were being very unfair.

I think more fans are concerned with getting the ban overturned (or at least a weaker sanction) than believing we will take UEFA down (in an enormous way). I think the media have pushed the narrative that a City win would destroy FFP but I think that's a big exaggeration. We don't even know for sure what we are focusing on in our appeal.
 
I believe the Conn article. I don't believe there was a moment where we could choose to agree or not. We were posturing. Whats important in my mind is what UEFA believed and the basis before the settlement. You may be able to re-open a settlement (and I remain in doubt on that) but UEFA definitely can't reopen it to complain about things UEFA knew in 2014. No chance.

We know the club felt strongly in Winter 2019 but thats not the same as having to decide whether to settle (or try to) this weekend just gone. By then they 1) knew they were facing a 2 year ban 2) Covid has happened 3) Each parties evidence and written submissions have been shared 4) they would have very well informed legal opinions. The parameters in which the club were deciding were different. I am not saying they should have settled, I am just saying emotion and other feelings in Winter 2019 that they had done nothing wrong (which by the way is not obvious on the face of the documents) is not necessarily relevant in June 2020.

The club had until Sunday to negotiate a settlement and very obviously the club was well aware of what UEFA was to submit to CAS

Surely this means IF the club was offered a fine to settle, it is as certain as it can be that City is very, very confident of a positive outcome

I disagree with this. Very experienced practitioners can frequently read the mood music based on the way the arbitrators conduct themselves, the questions they ask and the way they interact with the representatives of the respective parties. It's not a foolproof guide but they often have a pretty good idea.

I've tended to find lawyers try to dampen things down and stop clients getting their hopes up “we’ve done all we can, but it’s out of our hands now”.

If City had been offered a fine to settle before CAS, yes they would have taken (within reason). Of course, it would have been painful but sometimes the risk reward balance means you settle. City went in to CAS confident, I am pretty certain about that. Now? No idea.

@projectriver Why do you think UEFA objected to City offering articles A92,93 & 94 as evidence in the appeal. I read A92 was a newspaper article and A93 & A94 were communications between UEFA and City. I said before this gives me hope that these articles support our argument. What’s your take on this?
