CAS judgement: UEFA ban overturned, City exonerated (report out p603)

Anyone else wondering how we have sent 5.5m emails in 10 years? Maths isn't my strong point but I make that 10000+ emails per week, every week for 10 years. Some people at the club really need to get some work done.
It's not five and a half million emails, it's five and a half million documents
 
I’ve finished reading it all, most of it last night. Pretty interesting. It gives me more appreciation as to why I think City had a case to answer for, it’s the first time I’ve properly read the leaked emails as they were presented. They do have an element of suggestion in them if read without context, but as it clearly states in the judgement, even if they were entirely true, talking about an act of fraudulent activity is not carrying it out, and the absence of transactional evidence upon inspection shows that the claims are dismissed.

Its also a good reminder as to why I’d be a useless lawyer. A very humbling read.

For Arbitrations this is absolutely as strong as it gets. Suppose I could have used Arbiters instead of Judges.
DJ Fox in Oldham was certainly more blunt in his day but in Arbitrations the language is always much more conciliatory.
 
Fuck UEFA. They prosecuted this whole thing with no proper evidence. I don’t buy this “poor UEFA were forced to act by the evil G14 clubs”
If true all they had to say was “our lawyers say we can’t win”
They shafted us by moving the goalposts in 2014, they have shafted us numerous times in the Champions League and they banned us for 2 years acting as judge jury and executioner.
They despise everything about us and it’s mutual as far as I’m concerned.
After FIFA they are the 2nd most corrupt organisation in world sport, I wouldn’t piss on them if they were on fire.

Oh, I buy it, big time. If you’re talking about corruption in sporting organisations, I think there’s some serious competition for that.
I don’t think an attitude of ‘Fuck UEFA’ going forwards is the best way. We’ve just done that to them at CAS. I think there are some elements at UEFA supportive of us, and that’s what we need to bolster.
 
It doesn't do our credibility any good to say "they couldn't admit that obviously." The ADUG/SM source couldn't be proved - it was UEFA's burden and they could never hope to jump the witness statements (without cross examination) and letters on these points.

I thought that the sections on the settlement agreement were a little unconvincing - arguing the subject matter was different (para 154 says "these specific charges do not touch upon the issues addressed in the SA") is tenuous but, of course, arguable. These are all quite nuanced things.

The Etisalat was not backdated - it was signed and dated January 2015 but with an effective date earlier. That is, as Conn knows, not the same thing. Moreover the Heads were binding and specifically envisaged being in place prior to the full signed agreement. So I agree it is disingenuous.

Looking at the judgment, it is possible that if UEFA could have shown a more direct link to subsidies from ADUG/SM then they would have disagreed with me as to the importance of the legal sponsor contract and could well have found in UEFA's favour. In essence, that would have been a finding that the legal contract was a sham. Yet again a serious allegation with a high standard of proof that it was always likely UEFA couldn't hit.
Stefan do you agree with my view that by finding against almost all of our initial contentions thus able to use all the evidence UEFA used, they actually strengthen the fact that we didn’t disguise equity as sponsorship?
 
So can someone summarise for me what Vicky Kloss has had to say on this matter, what she has said to counter the appalling things being said about our club? Has she been as strong as ever in condemning the lies?

I think it's time for the club and fans to draw a line under FFP. We were found not guilty and now we can move forward with the developing the club and pushing for more success. It's important to have a good relationship with governing bodies, hence why Khaldoon and Cerefin had a peace-making call once the CAS decision was announced.

We should be focused on the football and long-term success, especially in Europe.
 
Seen posts on squawk that claim the CAS rep among the three judges had been employed by City at some time.
If City fans questioned the impartiality of the findings of the Hillsborough Inquest they'd doubtless be foaming at the mouth.
 
The thing I am struggling with is what advantage we gained by not co-operating with the UEFA investigation? I have no doubt that even if we had then UEFA would have tried to make something stick but we still would have had the option to go to CAS for a de bono hearing.

UEFA may well have tried to expand their investigation into a general fishing trip but at that point we could have refused to co-operate further and I assume CAS would have backed that stance. We have still come away from CAS with a substantial fine and, more importantly, we have been censured for non-co-operation thereby giving the media ammunition to infer that we were hiding something.
If you look at the documents in the judgment they are redacted as to various key details that City clearly want to keep private. CAS were able to engineer this. UEFA could not, therefore if City had released those documents to UEFA they believed that the full unredacted copies would have been leaked in line with other leaked information.
 
He might be but he prefers rags to us. Keegan family linked to rags. One of them is there announcer. Used to work at our stadium & jumped at the chance to leave us for them.
That’s a different ‘Keegan’...

Why are you having a pop at her? I'm fairly sure that any statement on such a serious matter would have to be cleared by Khaldoon or Ferran Soriano if not directly released by their office.

Was it a peace making call or was it a standby to standby type of conversation?
