You are misunderstanding the situation - if the value is set by a judge this is done retroactively. Messi is allowed to leave, without the fee being resolved. This is allowed, it has happened with other players in Spain - UEFA have no remit to involve themselves. He can request a transfer certificate from FIFA right now. He has the RIGHT, to unilaterally terminate his own contract if the release clause has expired, and to sign for another team.But it remains that if he’s under contract that he has a value as an asset to the club (ok decided by a court) and if he’s a free agent Barca have no say.
Additionally, if he’s under contract to Barca and we take him we’ll be punished as a club under EUFA rules (is it rule 17 that says that a club that takes a player under contract to another club is considered to have brought about the breach and that set punishments / transfer bans etc. follow?).
Thus it remains that the key issue is, is he under contract or not because even if a court can set compensation (as applies to the UK as well as a basic component of contract law) we can’t employ him without agreement from Barca, which could only to be gained by paying them what they want, because the punishment by the football competitions authorities would be crippling to us.
Is he under contract or not, and if under contract what will Barca sell him for, remain the key issues would be the case if the release clause was still active.

This is exciting because the judge would take in to account his wages and probably Ronaldo’s transfer fee (when he had a 3 year contract) - so if it goes to a judge we are looking at paying less than €100m.
This significantly increases our bargaining position and weakens Barca’s - who thought they had a buy out clause.

Why not sign Rivaldo, Maradona or Bebeto? Surely these are good players if you go by name only.

That's why every other club should be glad if we pull this off. Their tv income will be increasing even moreI’m not sure, he’ll be the jewel in the crown of the PL and will make our league even more commercially attractive than it is now.
Also, there will be so much scrutiny on him that the refs will have to protect him.
