Benjamin Mendy | Joins Pogon Szczecin (p92)

I don't like praising Ferguson, but one thing he always wanted was for his players to be settled and married as soon as possible. I think he thought it to be a way of preventing players acting the dickhead. Obviously it's not 100% perfect, but there's some positives to that approach.

However, a negative we've seen at City is that wives seem to want to live somewhere warmer/nicer than Manchester..!

Most of his teams were built around a British core including academy lads, who sometimes had already shacked up with childhood sweethearts.

Although that didn't really stop what appeared to be deluded entitlement and disrespect in the case of their own player who was charged with rape.

A prediction:

Mendy's lawyers will talk to City's lawyers.

Former will claim he's entitled to all earnings. Latter will claim his own actions (particularly breaching bail conditions to get banged up) mean he isn't entitled to anything. They'll split the difference because neither side wants this to get anywhere near court.

Which probably is about fair as whilst he was found not guilty of a criminal offence, his actions made him unavailable.
There is another scenario.
City and Mendy have already sorted everything out but he does not want to be declared bankrupt. For that reason his solicitor/ barrister at the Bankruptcy hearing made it all up to gain more time for his client.
In a few weeks/ months the Inland Revenue get their money and no one hears about it again.

Employment Law is similar to civil law where the burden of guilt is built around the balance of probabilities. I am sure that by his actions, guilty or not he brought the name of the club into disrepute which on it's own would be enough for any company to dismiss him. By being in the position he was in there was not a chance he would be able to play football for us so he would have frustrated his contract ( Frustrated contract .When an unforeseen event renders performance of a contract impossible or radically different from that originally contemplated by the parties. All future obligations of the parties to the contract are discharged) I don't think he would get far at an industrial tribunal

Yeah, but there's a lot of due diligence that goes on around players nowadays. It's not just footballing stuff, but also their attitude. However, ultimately, I don't think football teams give a shit about player's attitudes to women, they're more interested in their attitude to training and around the dressing room. You're signing boys and men in their late teens and early 20s. If you had to rule out anyone who was a bit of a pervert, there wouldn't be many left.
Is being a bit of a pervert similar to a bit pregnant? People’s private life’s don’t define them but there’s a line that shouldn’t be crossed.

He was still under contract to City until 30 June this year (we know this because that’s when he went to the Released List). So that means we never considered him in breach of contract/terminated the contract earlier.

If that’s the case, now he has been found not guilty, it’s hard to see how we don’t owe him wages for at least the period when he was available to train and play (remand feels more difficult for him). Can’t really see the counter argument here unless we had a specific contractual clause dealing with arrest, charge and being found not guilty.

Suspect it will be settled without litigation.
Your last sentence (which I agree with) is probably going to upset a lot of journalists. So that's a silver lining.

Mendy broke bail conditions meaning that he was then denied bail thus rendering himself unavailable for selection through his own actions. So wouldn't be due compensation from that point onwards.

There is probably scope on both sides for a p & c compromise if goodwill exists.

Senior City employees spoke favourably of BM in his defence.

City bought a player for £55million, paid him millions in wages & bonuses, and were unable to recover any compensation when he was in prison/remand or a fee (damaged goods) following his trial/not guilty verdict.

He was back in football at a reasonable, regional level,in his home country in 5 days.

Interesting to learn the outcome in due course !!

It’s likely that projectriver is more learned that yourself on such things.
