12 points on your licence

has anyone got to 12 points on their licence but has still (legally) been able to continue driving - my mate was stopped yesterday on the way to the match , he's a taxi driver and already on 9 points so he's a bit worried - not condoning what he's done but has any one got any advice to help him?
 
I'm not bragging but a few years back i got 13 points for speeding, I went to court and argued that i had extenuating circumstances, basically i needed my car for work so they allowed me to keep my licence but gave me a £200 fine and £100 court costs
 
Forgot to say your mate may need to get a letter from his boss confirming that he needs his car for work although saying that its pretty obvious that he does being a taxi driver

Basically your mate could get a ban but as he is a taxi driver that would cause extreme hardship or whatever so he should get away with it if he has a decent brief or a human being as a magistrate!
 
It may seem a bit obvious and a bit Julie Andrews-ish, but if he was speeding (I'm guessing it was speeding?) and he was already on 9 points, he's brought it on himself. To get caught once (and I have been done; 72 kph in a 50 zone. 3 pts and a €80 fine; koontz!) is unlucky. But 4 times? As I said earlier, I can only guess it was for speeding, as I don't know the history involved. If it involves drink-driving, sorry. No sympathy from me here. I've seen the effect on a family of losing a son through being hit by a DD. Twat. Hopefully, when the magistrate learns that it's his livelihood at stake, he will just nail him financially.
 
i dont think i should go into too much detail on here but he was doing 48 in 40 mile zone and was caught by a policeman with a radar - i only drive to and from work - so if you drive all day every day for a living your chances of getting caught are greatly increased - dont worry i took great pleasure in telling him ive a clean licence but that doesnt mean ive never speeded myself !
 
There was a story on North West Tonight last year about a bloke who had over 40 points but could still legally carry on driving. He proved that he couldn't work unless he could drive.
How the f*** he got away with that is unbeliveable.
 
if he's a taxi driver he should be able to afford Nick Freeman. He gets most people off.
 
You can get banned on a TT99 totting up proceedure only if all the points were gained in a 3 year period (normal points last for 4 years, dangerous, drink drive etc last for 11 years), but then the Magistrates don't always ban you.

In three where I was one got an £800 fine and no ban (he earned about £45,000 and it is means tested in around 1999), another got a smaller fine even though he earned more, and one got a six month ban but he did have more than one license and had been banned before.

In one of the cases the need car for work defense was met with, you can afford to hire someone to take you to work.

He probably does but you still smoke at CoMS.

What`s frightening is not that people speed (I have done all my life) it`s that they have such poor observational skills whilst doing it! i mean if you can`t see a tit with a radar gun ahead what distance in front are you looking? the quicker you go the further ahead you have to see to react to road and traffic conditions. speed does not kill as thwey tend to promote in their campaigns, but crap driving and poor observation do! incidentally I have driven for 27 years, virtually never at the speed limit and have never had a speeding ticket.

he can claim something called "extreme hardship" during mitigated circumstances....if he gets a letter from his boss or even better works for himself, then he basically claims that this would lead to him losing his house, etc.....if his wife doesnt work and he is the sole breadwinner, this also goes in his favour

i know someone who was still driving with 16 points on their license (nudge nudge)


if it was a fixed camera then the chances are very limited in challenging the conviction...other than something which may happen in the future (see below*)

if it is a mobile site, then usually the police use something called the "LTI 20/20", more commonly known as the dodgyscope to some of us....usually when you technically challenge the radar gun in court, the cps use a specialist witness to disprove your theories...this witness is the manufacturer of the radar gun, therefore he isnt going to side with you

recently, in a court case, the defense lawyer picked up the radar gun and pointed it at the wall....astonishingly, the gun gave a reading of 2mph....he then moved his hand slightly whilst targeting the wall again and to his amazement the wall had clocked an overall speed of 9mph...the manufacturer argued that the initial 2mph was a tolerance built into the gun to make it more accurate :S :S :S

however, he couldnt explain the wall showing an additional 8mph....this was argued by the defense that if the officer first zaps you on the windscreen and records a distance, then on the second zap, the officers arm was slightly lower and he zapped you on your bonnet/reg plate, then this increased distance (windscreen to bonnet) would record false readings....you will find most mobile sites now are fixed on trpods at side of road or in vans.....just to stop this defense claim


also*.....at present there are a number of UK drivers pursuing appeals in the european courts of human rights...now some may laugh.....but hear me out!!

if i murdered, robbed, raped....i would be read my rights before i was asked for any statements...i would also have the right to remain silent for fear of incrimination.....dont forget......they have to prove guilt...although in reality it is really the accused having to prove innocence

why is it then i can go 5mph over a speed limit (you are ALLOWED 10% + 2MPH btw) and i am given no rights what so ever...i am expected to give a statement that incriminates me or others and if i dont, then i will be gulity of a totally seperate offence of failing to give information....ALL THIS WITH NO RIGHTS

this is currently being appealed in europe...and if it sets a legal precedent then we will see a police officer having to travel to my house and read me my rights before i admit to the offence....now i work in scotland.....devon....london...wales....so imagine the amount of travelling...and times this by 4000 speeding tickets a day and sooner or later the system will grind to an halt


this may not be of help to you, albeit the extreme hardship may be....but knowledge is power and its good to know that these gatso squads are not going to get it all their own way

If you can see them, then obviously they can see you. That being the case, if they have an unobstructed line of sight to your car (i.e. no other vehicles in between) then, to cut a long story short, you've probably been nailed.
