- We went to Rotherham…
Tevez must be shitting himself now the FIFA president has said if the allegation is true and City sack him FIFA will ban him from playing.
Silva Service said:Legally its complicated.
His refusal to come on is probably significant enough to constitute a 'material breach' of contract. If so, City could treat his breach as de facto repudiation of the contract, accept that he has in effect walked away from the contract and so terminate the contract (sack him) and stlll sue him for damages.
This is where it gets tricky.
The level of damages is based on what money City have lost by Tevez refusing to honour his contract. Leaving aside the issue of potential Champions League/competition revenue lost, the major sum would be the money City would have received from any potential sell on in January. In effect, Tevez could be sued for his full market value which would be a huge hit for him. That is why he was backtracking big time this morning - saying he was ready and willing to honour his obligations.
But by then, the damage had already been done.
