City cleared of any wrongdoing in Garre case - no transfer ban expected

So the questions are:

1. Was he still contracted to Sarsfeld at the time he left for Europe?
2. If no, then there's no issue. The lad flew to Europe and then exercised his EEA treaty rights as an Italian national to come and live/work in the UK.
3. If yes, then is he eligible under FIFA rules to move to another club once he turns 16, regardless of whether he has a contract elsewhere (ie. can he walk out on Sarsfeld without recrimination)? If yes, then again there's no issue.

The one aspect of this I don't like is that the boy flew to Europe on his 16th birthday and then on to the UK the following day. Can Sarsfeld argue that he had to have been tapped up for him to sign for City so quickly, given that the Argentinian club had refused our approaches for the lad when he was still 15?

FIFA have got Gill at the helm, ergo they are untrustworthy cnuts. I wouldn't put anything past them in terms of not having taken action against us, knowing that the next option for Sarsfeld would be to take the matter to CAS where there is no right of appeal.

All I can say is that City must be super confident about the matter, given that we haven't settled out of court so to speak

There would be no ban this window in the unlikely event of any ban at all , so no it's not the reason. Pre season is the reason.

Thanks for the info! I had only read some limited articles on it so this helps, I hope we dodge a bullet on this one and I'm sure you're right about us being confident going into this on Monday....
 
City are adamant that this transfer was legit and was approved by FIFA, in which case the fault lies with FIFA regulations and not our incompetence. Much of the M60 circling Manchester is subject to average speed surveillance at a limit of 50 mph and to compare it with this transfer then it would be like reducing the limit to 40 mph and then backdating it by a week thus snaring thousands of previously innocent motorists. It just wouldn't be done, and similarly FIFA will just be ordered to update their regulations, and City will be in the clear

Have i understood this right Fifa have said we have no case to answer? And this is an appeal? Anyone have any insight in how many of the decisions made by Fifa get overturned?
 
If this goes tits up again we've dropped a clanger. Yes the deal was ratified by FIFA but this was an almighty risk given his age.
We've already been punished for the drugs test and the academy ban, let's hope we don't get an unwanted hat trick.
If the governing body of world football said it is OK, then I'm not sure how anyone can say it was "an almighty risk" and that City could get dinged?

Surely, FIFA was fine with the deal under FIFA's own rules and were told everything was done above board. If CAS want to overturn it, then let the unhappy lad go back and see how happy he is with Velez then!

And, I'm not sure why CAS (who exactly are CAS anyway?) is getting involved when FIFA runs the sport?!

This smacks of the EU, where British law gets overturned by some EUrocrats. Everyone is a fucking busybody nowadays and the levels of faux outrage everywhere about everything is feeding their lust.

No more 'It's quiet'. It truly would be quiet. Tolmie would need to find another job. Ric would have to file for bankruptcy. MattyB would be made redundant. MCRJON would miss his annual post and time out of the forum with a password reset. We wouldn't be able to sell Hart or Bravo. We would have loads more inane threads entitled 'Tony Henry's best game', 'Anyone ever buy a shirt off Buzzer', 'Remember the buses on Princess Parkway'. But at least Marvin would have no one to argue with.

I believe cas will uphold the FIFA decision. Mediation will conclude with a payment from city to sarsfield.
