I'm not sure about that. In fact the I'm sure you're wrong that it's not passing judgement on the case. However, even if they have rejected the three specific questions they've been asked to rule on, which challenge the legitimacy of FFP, it just means everything gets shifted back to Belgium.it's nothing to worry about it's not passing judgement on the case at all.

The BCFI will presumably reject Dupont's case and it will then go to the Belgian Appeal Court. It's expected to be another 12 months before that appeal is heard.
He's lost a battle but the war has a long way to run.
