It’s absolute bollocks. Like trying to convict someone for driving 30mph in a zone where 30mph was once permissible but now isn’t.
Unless the people who drew up the rules, knew that driving at 30mph was already illegal, yet turned a blind eye when writing the rules. Just so their favoured ones could do 30mph illegally, which seems to have been the case.

As much as I like the idea, that doesn’t sound like a realistic possibility to me.

It's possibly just positioning that if you think you can't apply the loan issue retrospectively, you also can't look at historic sponsorships, like Etihad retrospectively either, otherwise it's err .... unlawful under competition law again.
