Isn't it common practise for the police to have to be convinced themselves before referring files to the CPS?
The police have to believe there is sufficient evidence to refer it to the CPS, if not they dont and can knock it on the head themselves. There are 2 codes to meet, a full code test and a threshold test. A threshold test is when not everything is gathered in but will be and there is a need to seek a charge, for something like a remand application. The full code test will have to have been met, which is essentially the key evidence is all done and nothing is outstanding, and there is enough to warrant it being referred to a lawyer. The police have to do this for everything but minor charges, they do not authorise charges themselves
