Just after some advice if possible...

I got divorced 2 years ago,my daughter lives with my ex and my son lives with me.My ex originally made a claim to the csa,thinking she could get more than the £80 a week I was giving her,turns out I only had to give her £47 a week through the csa...She rings the csa and says we have a verbal agreement and she doesn't want to go through the csa,so I continue to give her £80 a week....2 years later,she says to the csa that all the money I've give her is to help towards the mortgage and NOT for child maintenance....the csa ring me and now want just short of £5,000 back pay.

Has anyone else had shit like this?
Any advice would be greatly appreciated.....thanks.
 
provide proof of the money you have paid. put in a claim for your son with them to get money off her. drop the money you pay to £47 or whatever they say and use the rest to treat the kids when you have them both.

Not advice but surely if you both have 1 child each, then there shouldn't need to be any money exchanged?

That's what i was thinking!! Why haven't you been to the CSA to get money off her for the child you look after?

What I didn't know is....you can't claim for a child even if they live with you,if YOU don't receive the child tax credit and child benefit...which I'm now in the process of doing..the csa acknowledge the fact he lives with me,but because I don't claim the benefits I'm not entitled to make a claim against her...also told me I still have to pay the 5k....unbelievable.
 
Mate, I will say this once and once only, DO NOT TRUST A FUCKIN WORD THOSE WEASELS SAY TO YOU, had my own experiences similar to yours and more.

As far as I'm aware (and this happened with me but may have changed) when I was unemployed I continued to pay the mortgage out of my savings, this actually went to pay off part of the alleged debt they said I owed (but they knew I didn't as it was clear I was claiming JSA for the period they were claiming for, records they had in front of them, but claimed I didn't tell them, which I did, so they billed me for 6 months of my previous (and pretty well paid) job.

After about 9 years, even though that 7 year debt thing applied at the time (which they changed the rules for with the CSA), within weeks of that being passed, they were back in contact with me wanting this money, so I just paid to get them off my back, but you really need to go to the CAB on this.
