Donald Trump

The word “round” is giving me concerns here. A circle is round and a plate is a circle so there will be some who might have answered incorrectly, thinking that they determine a flat earth like a plate and hence, round. And of course the earth isn’t round it’s ellipsoid so there’s the smart arse response too.

Or smart ass in America.
Isn’t it an oblate spheroid? ;-)

It is, but they are just a type of ellipsoid.

Very true but to do the earth real justice you need to take into account the geographic features that are not part of that ellipsoid and create a datum reference, hence the geoid and the World Geodetic System. Bit geeky but beats thinking about the tango faced sociopathic twat getting back into power :-)

It’s an oblate spheroid if you want to get smart.

I think he’ll “win” on the 2/3 Congress rule, namely, congress can overturn a decision that says the person committed insurrection. I think they’ll argue that this hasn’t been applied.
My reading, hands up I may have misread, is that a person barred for insurrection may have that overturned by 2/3 of congress so it doesn't apply unless SCOTUS uphold the bar.
I very much doubt wether he'd obtain such a majority in either house.
If SCOTUS reject Colorado & Maine it looks really bad for SCOTUS on the "Officer' issue in light of originalist thinking apropos court & Congress decisions following the Civil War, or for Federalist thinking apropos the "finding of fact" already determined by 2 x State Supreme Courts.
Would appreciate anyone with better knowlewdge correcting me.

The Prosecuting Trump podcast yesterday explained the 2/3 Congress thing much more succinctly (and accurately) than I ever could!

I don't disagree with any of that. It's very old legislation that was not worded well although the intent seems clear. Its the mechanics behind the intent that have allowed Trump to put forward a number of arguments. The federalist/originalist view would be to stick to the intent and ignore the details. This time round most expect the conservatives to use the murky detail to step in and help Trump.

Let's see how far they go.

Given the current make up of SCOTUS, they will rule that a state cannot bar him unless Congress votes for naming him as an insurrectionist.
