Yes thats correct the judgement will be announced sometime in January but what FC have to be careful of is if the judgement goes in our favour then MCC and FC have to make an appeal and how long will that take ? also can MCC justify spending money on an appeal when their cutting budgets, services and jobs how is that going to look, I'm sure MCC will have no loyalty if that is a scenario also FC have funding set up from various organisations which rely on things moving on with a positive outcome their not going to keep hanging on if things get bogged down in appeals etc with no guarantee of a favourable outcome, if they get the decision then we will appeal again were back to how long will that take ?


Not forgetting the tax payers money on your appeal, wasn't there a discussion a few pages back on wasting tax payers money.

I'm with you, lets form BlueMoan F.C. I will toss you for, no I wont we'll flip a coin for the role of Chairman, we can flog a few tatty scarves and mugs and then apply to all of the above for 50k. OK some will knock us back but it seems they are easy to con out of taxpayers money so 100k each should do us nicely. We dont need a team, well fcum manage with out one !!! and if Sport England can cough up £750,000 for a fledgling muppet outfit I don't see why we dont try it. Anyone want to play in goal?

I,m surprised our two friends haven't posted the latest story on here yet!! maybe there a little embarrassed. it really is clutching at straws.

FC United’s new stadium could be used by the club to ground-share with another professional team, opponents of the plan have claimed.

A judicial review into the application for the 5,000-capacity ground in Moston heard that the club has agreed with the council that no more than 50 games a season will be played.

But local opponents say planning reports were based on just 30 matches a year.

And they claim the extra capacity opens the door to FC United inviting another professional club in to the ground.

Barristers for FC United told the court that local side Moston Juniors would be invited to use the ground for big games, and residents ‘wouldn’t even notice’.

But Hugh Richards, representing the Residents United Residents Association, said: "The club is not prevented by any planning regulations to saying to another club – for example Bury – ‘come and play at our stadium’ and that is what concerns residents.

"There has been no noise report carried out that has said whether or not having 50 games at this stadium is acceptable."

FC United currently play 21 home games a season as a Northern Premier League side. If the club was drawn at home in every round of the three cup competitions they are eligible to enter, they would host 43 matches.

Sasha White, representing the club, said: "The reason we’ve agreed to a limit of 50 is so that Moston Juniors can be allowed to use the stadium pitch.

"One can reasonably forsee that unless Moston Juniors welcome a guest appearance from Messi or Ronaldo they will draw nowhere near enough of a crowd to make noise."

The court also heard the project could yet collapse if delays forced the Football Foundation and Sport England to withdraw £1.4 million funding. In total the development is set to cost £5.3m with £1.725m coming from donations by club members.

The hearing, at Manchester Civil Justice Centre, came after residents claimed the decision to grant planning permission was illegal as proper impact assessments were not carried out.

Richard Drabble QC, representing the council, told the court that following an initial ‘screening process’ the assessments were not required by law.

He said: "These impacts were of limited magnitude, of limited complexity, were confined to a local area, were entirely predictable and could be mitigated.

"The actions taken were for the judgement of the planning authority and wholly consistent with guidelines from the Court of Appeal."

A decision is expected early next year.

Does that mean you have a legally binding agreement to give the stadium over for use by Moston Juniors when you are not "at home"? Could be a real money spinner sharing your ground with another professional club if you haven't.

Apologies for not replying earlier underthemoonlight, just done a 14 hour shift at work, not embarrassed in the slightest, it's the MEN sensationalising one point made by the barrister out of many, that's all, don't get yourself worked up about it.... or maybe you are worked up about the judge ruling in RURA's favour?

A couple of questions on the FC forum :

mickthered - beginning to wonder if they really give a toss of the ground being built or not

or is it just a way for them to con money out of other blues and unsuspecting locals all donating money whilst at the same time they are claiming legal aid

I wonder what happened to all them donations

That's an interesting point. It may also be worth wondering if there were any donations in the first place. We are dealing with habitual liars here, so nothing should be taken for granted.

Ladies, Ladies, Ladies don't get your knickers in a twist every penny is properly accounted for and logged. When you apply to the court asking for a JR they consider the request then ask you to put up a not to insignificant amount of money based on certain factors one being where you live, this is to show to the courts that you are prepared to fight the case so thats where any donations have gone and are all accounted for.
