Government loses Abu Qatada appeal

This case is not as straightforward as the press makes out and the way the home sec has acted occasionally been embarrassing. Due to the nature of the case the technicalities she keep cocking up with can been hidden under the OSA.
 
Case isn't black and white.

Some of the evidence that exists which would allow an extradition to Jordan could be obtained by torture (most like water-boarding).

So the case becomes do we allow confessions from torture to be used as evidence?

The courts have said no.

edit: I may have got it wrong and that it is likely that if he goes to Jordan he will tortured.

Some say they don't care, some say they don't want to give a government the power to allow this.
 
As a nation we are a joke. A complete laughing stock.
The French removed similar people without any legal action - they were put on a plane and kicked out! The USA wouldn't even blink an eye - he would be gone.
Us - we go thru 6 years of extremely costly legal action (Qatada's legal bill is being picked up by me and you under legal aid by the way) and we still can't remove him.
It's pathetic. It makes you embarrased to be English (yes I'm English - not British).

Key Paragraph being 34-37 and 56-59.

Apparently Abu Qatada did have confessions from torture 14 and 12 years ago. This is the evidence Jordan uses to want his extradition and was used to convict him in his absence.

The question then becomes do you approve of evidence obtained by torture. The courts have ruled no, whereas the government believes yes.
 
Bung him on a plane, take him to Jordan, leave him there. Then argue the legalities of the matter afterwards. It would hardly be the most controversial thing this, or any UK Government, has done. Hide who gave the order behind "national security" issues and, in 25 years, when the documents become part of the public domain, no-one will give a shit anymore.

Whether he's guilty of the specific crimes he's being charged with in Jordan or not doesn't change the fact the UK would be infinitely better off without his hate mongering going on on our shores.
