I liked the bit when he was asked if he was being paid when he went back to argentina and he said "no, carlos is not the type to want to be paid if he's not playing, he could have stayed to train with the reserves and be paid but he's not like that". How very noble of him!.

He was fined 6 weeks wages in december for not turning up since early November, and he appealed against that to a panel of directors. They dismissed his appeal earlier this month, as Khaldoon said the other day.

Why appeal if he didn't want paying?

I'd have in back in a flash, don't give two hoots about what he's done or said. All I'm bothered about is winning the title, why wouldn't you want a world class striker at your club to help with the run in.

It's about thinking like a champion and a champion would take what ever edge he can get away with legally or illegally and I think Carlos would give us that edge now.

For the record I dislike what he's done as I thought he was a better person than that, but an apology and seven to ten goals would help me to forget. I'm fickle I know but I want to win and if that means swallowing my pride then fuck yes I'd swallow my pride. If bobby wanted him back then I would back roberto, if he doesn't then I wouldn't think twice about Tevez.

Obviously none of us know what is in Tevez's contract but to fulfill his contractual obligations - i.e. be available to play; I think we can safely assume he must be present in the UK - you would think. Unauthorised absence - i.e. buggering off to Argentina must be breach of contract (you can't play in the English Premier League from Argentina) especially since he has been gone for more than a few weeks - i.e. playing golf and running on the beach hardly counts as tending a family crisis. He has obviously been invited to and not attended a disciplinary hearing (and an apppeal process to boot) so it would be interesting to know what he was found guilty of? I can only assume gross misconduct. In which case the club may have effectively terminated his contract - in that he is no longer required to play, he isn't paid and we just hold on to his registration until we find a buyer ! But that would contradict what the Chairman said re his obligations under his contract. So perhaps his contract remains in place but he isn't paid until he returns to the UK and makes some effort to fulfill his contractual terms. However, and its a significant point he is actually guilty of two seperate serious offences, the issue in Munich which he was found guilty of is wholly seperate from the AWOL offence he has now committed (and his guilt in this regard cannot be seriously questioned - where is he?) - so even if we were lenient and just fined him a couple of weeks wages for the first offence you'd have to think he has got away with murder to just be fined this time around. You do wonder what do you have to do to get fired at City? (apart from insult Nedum's mum). Kia's comments today seem to suggest the little s**t will crawl back and go through the motions at Carrington to earn himself a few quid a week before he leaves in the summer but you can't help thinking we have been very lenient or maybe its the contract and we have no room for manouvre - you feel sure we will have had the legal people all over this. Still Gordon Taylor (his chief apologist) seems to have done one! I bet he feels a right tit now.
