Barcelona haven't paid Quique Setien and his staff their severance yet, he's had to go to court to get them to pay.

The chances of Messi getting his €38m without a fight is pretty much zero IMO, although I'm sure he will win in court eventually.
 
There's no upside to Leo signing a pre contract somewhere else even if his mind is fully made up to leave Barcelona. Look at the wildly political nature of their football press and the way that the clubs use it to serve differing agendas. For Messi, a pre contract would've meant six months of speculation every time he missed a pass or a shot as to whether he'd already mentally checked out of the building. It would tarnish the legacy he has. IMO of course.

As it stands his silence and his continued performances on the pitch have ensured that come the summer, he'll be able to wave goodbye and walk out the front door. Probably with the blessing of the entire Camp Nou.

It may be linked to his final loyalty bonus too. Signing a pre-contract agreement may null and void his last loyalty payment, so unless the new club is willing to stump up the €40m to replace it, it seems a pointless exercise; especially if he has verbally agreed with the new club anyway.

if it is like this country no one needs to know about pre-contract agreements even the FA.

It is normally just a written transfer request and which voids the loyalty payment, and the player leaving before the end of his contract due to this request.

Totally. The Spanish system seems crazier than ours and ultimately, the wording in Messi’s contract will be the defining factor to what surmounts to breaking his loyalty clause.
