Moral dilemma, advice required

Heard anything from the dealership yet?
Got a call about an hour ago from the "after sales manager", just confirming that an investigation has been launched, and the technician has been made aware of the situation, the replacement part has been ordered and I'm invited in to see him on Friday afternoon... So here is the dilemma, potentially the mechanic possibly might get the boot depending on how far I push it :-$

These aren't your average back street grease monkeys and, I'd have thought, have been specially (expensively) trained by Mercedes -I doubt they'd sack him just give him a good bollocking ;-)

But what if they do,and he has a wife,or wives and family dependant upon his wage. It's the dole or the workhouse and he'll never get a decent job afterwards, destined to a life of temporary shelf stacking on nights at Lidl at best. If you want that on your conscience then feel free, hang the man out to dry for a simple mistake and no one on here can say they haven't made a simple mistake. Heartless bastards all of you, hang your heads in shame.

How much do you reckon you'll get ??

If the mechanic involved did this to your car, what's to say that he's not done the same to others?

If you were on the M60 maybe you could see if HA have some footage of the incident, that would make Mercedes squirm if you had that to hand.

Pretty sure HA won't just let you have it - data protection act - you'd have to go through a solicitor.

I think a lot of people are being a bit OTT with this - someone forgot to tighten up some bolts and a belly pan came off. Nobody was hurt, nothing was badly damaged and the dealers are replacing it and speaking to the owner about it.

I know someone could have been hurt but you could say that about a waitress spilling coffee - I COULD have slipped and fallen on a glass and severed my artery and bled to death. As it was I stepped in it and nothing serious happened - but I'm going to kick up a fuss and see what compensation I can get.

It was a mistake, get it sorted and see if they offer you a bit of something to make up for the time you've spent messing about and the upset it caused.

That would be the realistic and sensible thing to do but this is Bluemoon....go for the jugular

That mechanic's mistake could have killed you and even others if it had caused a pile up. He deserves to be working a till at Asda so don't feel guilty if he does get the boot.

Update:
Went into the dealership yesterday for a meeting with the "after sales manager". Spoke at length about what went wrong, how it probably happened etc, and he said he'd interviewed the technician, who ended up getting disciplined (not sacked, so that's very good), he said that as a way of apologising, he'd like to make me a good will gesture of a discount on my next service. I started to laugh asking why would you think I'd come back?
Anyway, the conversation continued (my car was on the ramps at this point) and after an hour or so managed to convince him that, 2 new rear tyres (about 300)would be nice and I've also lost my spare key, so a replacement (approx 290) and a valet, would seal the deal, and I wouldn't pursue the matter any further.
I thought I'd push it a bit knowing the guy kept his job :)
What do you think then? Good deal? Bad deal?

I think it's a good deal. It's very hard to pursue a legal claim for potential harm/damage. I had nothing but problems with Mercedes when I had one of their cars, but it sounds like they've been fair with you.

By way of comparison, a friend of mine bought a brand new ford focus estate a few years ago and driving it home from the dealers the engine virtually fell out of the car on a dual carriageway. He had a job getting them to replace the car, the dealer wanted to repair it. He took legal advice but was told to basically do what you've done and ask the dealer for a gesture of good will. He got one free service.

I think you did pretty well. In fact I think you did very, very well. My mate had a Mercedes van that, in its first year, literally spent more time in the dealership than it did with him. One thing after another was going wrong and often the fixes didn't work. He demanded a new van as that one was not 'fit for purpose' They said that they provided him with a hire van of the same size and were fixing it under warranty all that was all they had to do. The fact that he had his van fitted with a shelving and storage system was irrelevant to them - it was a nightmare as he usually set off at 5am to avoid as much traffic as he could but had to wait til 9 or even later to get his courtesy van sorted out. Then he was travelling up and down the country with fragile plant pots and very expensive bonsai trees just stacked up in cardboard boxes. Despite his threats of legal action they stood firm as they know their rights and knew that one unhappy customer wasn't going to have much impact on their sales.

£600+ of apology is perfectly acceptable - although there'll be people who have obviously never dealt with anything like this saying that nothing less than a sacking and a brand new car with unlimited servicing would suffice for them. But I doubt they have ever dealt with anything like this and are clueless about the reality of a dealerships responsibilities and how these things usually pan out. ;-)
