I’ve obviously missed it. Why is the hotel in breach?

That condition was 'no above ground works'. It was originally pre-start of any kind but they managed to amend it. Technicality of course, but anything above ground is by the wording, a breach.

Not that I think the planners would raise it, just a bit awkward going past so much built stuff. Remember they were originally meant to have the panel installed in April, so there would have been much less to ignore.
