off school sick and a penalty fine

ok,,,my daughter was off school from Monay -Friday a couple of weeks ago, we phoned school and told them she had spots on her back 'possible chicken pox' and we would keep her off, the spots started to clear up by the Thursday however we kept her off and she returned to school on the Monday ,so she had five days off,,Saturday a letter has arrived from school saying they believe we were on holiday 'which we were not' and they are marking her absence as without permision, this i believe triggers a penalty notice with the local council,,,can the school do this as they have no proof ? and it did not happen

It would appear the school have as much proof the absence was unauthorised as you do that she had chicken pox.
 
Ring and speak to the person who has signed the letter
Ask them where you went to on holiday
Tell them you are refusing to pay, if nessecary will see them in court where you will also claim back expenses off them for a day's unpaid leave from work
 
You keep your daughter off for a week without seeking medical attention. Really. Just pay the fine and stop wasting everybody's time having to read your bleatings.
 
Whether you were on holiday or not (I know you weren't) I assumed schools would be packing this shite in after that fella took it to the high court and they ruled in his favour. I'd definitely tell them they will have to take me to court and not a fucking chance I'd pay a penny.
 
I'm sure that bricking windows or going to court with Google as your witness will be more entertaining but my suggestion, assuming you're interested of course, is to simply ring the school, or pop in, and explain their mistake. If they have any sense they will accept it and that will be the end of the matter. Failing that go through the process of letting the head know, then the Chair of Governors and then the LEA if required. If for some strange reason it goes to court brick their windows and get Google as your expert witness.
 
It should be set out somewhere how long a child can be self-certified as ill. Beyond that requires a doctor's note. In many places of work the self-cert period is only 3/4 days.
