Pesky Do Gooder Lawyers force HMRC to tax Uber

Landmark legal ruling today , is this the end for Uber , Deliveroo etc ?
Possibly.

On the one hand it will mean people immediately out of work but the gig economy is a bad thing imo and in the long run this is better for people.

If anything it shows why our institutions are so great, the Supreme Court ruling on the side of the little guy should make us proud to be British.
 
Anyone who knows anything about employment can see why they ruled in this way.

The court considered several elements in its judgement:

  • Uber set the fare which meant that they dictated how much drivers could earn
  • Uber set the contract terms and drivers had no say in them
  • Request for rides is constrained by Uber who can penalise drivers if they reject too many rides
  • Uber monitors a driver's service through the star rating and has the capacity to terminate the relationship if after repeated warnings this does not improve

The gig economy is not a bad thing as such. It suits many people who need some form of flexible working . But as a former IT freelance contractor, a group who HMRC who have shit on as disguised employees for a while, and have basically killed off, I really don't understand how places like Uber have got away with this shit for so long, where drivers are clearly employees.

I am in favour of this stuff as a choice. Zero hour contracts suit students and people who want a “top up” on earnings.

But it should be a choice. Uber should have to offer employment to these people and give them a choice.

Regarding your point on IT, I know the industry inside out, as I’m a recruitment manager who has 80+ contractors I personally manage, in the IT sector specifically. So in another life we could have worked together.

IR35 is complex and is a poor one-size-fits-all approach by Her Majesty’s Government. Some IT contractors we have, have been operating as Outside IR35, on £800 per day contracts, whilst being onsite for years and being treated like an employee. That’s unfair. However at the same time, I have guys on £200 per day, who only find work for 6-7 months of the year, and they’ve been absolutely shat on with the legislation changes.

Ive given you two extremes there, most fall in between these people but my general point is that I do agree with you, somewhat.
