I think this is pretty close to the mark. Its provocative and he's rubbing it in by putting up an arsecrack of a fence to be a clever bastard. Don't bite and take it down, that's what he wants and probably expects

To be fair it's not that bad.Dont know how he's done it but if that's what you're looking at he's looking at the battens and fixings and a few climbing roses over that will look smart in a couple of years.

^^This. I honestly think that's reasonable. It would have been good manners if nothing else to ask/tell you first, but you are starting to sound a bit petty TBH with all the legal shit about half the width of a fence-post. Straight away it looks like that back window on his place would make it feel like a goldfish bowl when you and yours are in the garden - which like us all you probably have been during the good weather. I don't think it's anything more, and as has already been said he's had the manners to put the ugly nuts and bolts side in his garden.

Fencing should be fixed vertically anyway not horizontally

Nail some waneylap to it.

Vertical and a really dark stain would have looked better

It really does! We have something very similar to this dividing the driveway/side yard and rear garden:

A smaller version of this on top of the wall here in the OP's garden would look good, if a fence is required. I've never seen a fence going horizontal like that either, not with what looks nothing other than floor boards at least. It's a bizarre choice.

I think it looks OK.

Its given you privacy in your own garden and its cost you nothing.

If you don't like the look of it, there's room on the wall to put your own fence or decorative woodwork in front.

Do you not need concrete posts with that?
The fence in our back garden needs replacing due to the wooden posts rotting, although I don't know what we would do in terms of cost as the adjoining side it a rented house.

No, ours is supported by wooden posts. I put the fuckers in the first day we moved in and that was 7 years ago. The only bit of proper DIY i've ever done that worked out!
