If we break it down though. My mate sends me a racist joke i read it get distracted and it stays on my phone. Later that day something happens and police come and have a look through my phone. Is it my fault a mate sent me a text?Damocles said:Hope so.

The people in the situation I described worked for a large public sector organisation that spunks loads of money up the wall on promoting diversity and provides highly paid non-jobs to an entire department headed up by Pro-vice Chancellor of Diversity and Equal Opportunities. If it had just been jokes, I would have sacked the dumb woman for just being stupid enough to send that sort of thing from a work's phone. The messages in question though were comments such as 'can you get **** to go to ****? That useless n****r hasn't shown up again'.
That does not sound like a joke sounds like someone who has problems with ethnic minorities. That is a sackable offense.

You can already be charged for sending them, it's an offence under the telecommunications act. I think it's rarely enforced however, if two like minded individuals want to send them to each other then there's no injured party to get upset and hence no complaint made.
Personally I don't tolerate racism so I don't receive them (an uncle used to send racist jokes but I told him I'd prefer not to have them so he stopped).
I don't think there will ever be much of an appetite for charging people with sending jokes (or for creating a new offence of being in posession of a joke), the authorities are stretched enough as it is.
