It’s not rape to have sex with a fifteen year old when consent is present, but it’s 100% the offence of sexual activity with a child, irrespective of the presence of consent. It’s only if the victim is under 13 does it automatically become rape via a necessary legal fiction because legally someone of that age is deemed incapable of giving consent.

Sexual activity with a child is the offence Adam Johnson was convicted of for fingering a 15 year old (with consent) and it carries a maximum sentence of fourteen years imprisonment.

So what Cheshire Police told them about rape is correct, but based on what you’ve described a very serious offence has been committed, and there is no good reason why the 20 year old wasn’t arrested on suspicion of that offence. Difficult to imagine Cheshire Old Bill not being aware of that. Seems like a bizarre exchange tbh.

In our niece’s case it wasn’t rape either but it was (as far as I’m concerned) illegal and if the parents wanted to have the lad charged (they did) then it makes a mockery of the age of consent / law
 
And yet this thick as fuck unremarkable idiot managed to persuade the police and her school she was at low level risk of being radicalised, managed to get through Gatwick Airport on a stolen passport that allowed her to pass as the adult responsible for two other minors and managed to find her way from Istanbul to the Syrian border.

Quite a few people in places of authority have got some explaining to do.
I don’t know the circumstances behind any of that -probably no one does other than her - but it seems clear from what she says in interviews that she is thick as fuck, probably not assisted by not being in education from the age of fifteen.

Consent is a complex thing and isn’t always as straightforward as a simple yes or no. So it’s perfectly conceivable that the offence of rape arises in certain circumstances where there may be an arguable case for consent and the issue of consent can more easily be established where the victim is young and more easily exploited and manipulated. Sometimes consent is the only issue to be litigated and is down to the perception of each of the individuals involved.

Sexual activity with a child is a commonly charged offence which can cover activity from kissing through to full sex. Sometimes when the age gap is narrow (say, 17 and 15) a charging decision is made to not proceed in the public interest but 20 and 15 would not ordinarily fall into that bracket.

Like I said, a strange response from Old Bill based on what you’ve said.

The girl didn’t want the lad charged.. The parents did (so would I)

The SIAC judgment makes grim reading.

Looks like the school had concerns and contacted the police , the police said “nothing to see here” and the school said “oh well, that’s alright then”
