Aguero doesn't sound as sympathetic as Zabaleta.

I am equally certain that he will be getting paid. Until the case has been fully investigated, you cannot legally withhold pay. Likewise, if a player is accused of rape, he shouldn't be punished until the verdict has been reached.

Depends on the terms of the contract.

If it is found that he refused to play then the club is in a stronger position to suspend his pay.

If it turns out it was a miscommunication or it cannot be determined what actually took place beyond any reasonable doubt then we will have to pay wages to someone that a manager doesn't want to play.

As I have stated before hopefully the Corinthians deal can be revisited in January.

Having Tevez on our books may have implications for our first team squad numbers and Europe so its important we get a quality replacement in January for the run in.

yes it does and you're right, however you must always deal in 'good faith' and in any contract there must be trust between the parties involved.

if you attack a contract in this way (no matter what the other clauses and remedies are; no matter what the boilerplate) you can effective unilaterally terminate a contract for a fiduciary breach of trust.

effectively how can the other party offer to remedy a breach of trust? (they can't)

most of the time you can use the above approach to renegotiate a contract that is favourable to the other party but not to you; the rest of the time you might use additional leverage or methods to do so depending upon the exact agreement you have (your starting-off point) and the context of the situation.

getting out of Tevez's contract on a breach of fiduciary duty isn't going to be that difficult at all due to his sustained transgressions and behaviours.

ultimately it will be Manciti who decides what will happen, and my guess is (at least from the last 48 hours) he's been pretty clear and firm about that... the rest is just up to the club in how they choose to execute his lead, but it shouldn't be too difficult.

I wouldn't take anything Zab says too literally at this stage. It could well be that he's furious with Tevez (the TV footage certainly seems to indicate this) but is adopting a diplomatic stance in public so as not to exacerbate the situation further. He seems too much of a gent to go off on one about it.

Aguero's comments are a bit more blunt but again he's being quite tactful about it.
 
Footballer's rarely go public and criticise current team mates, especially when they're fellow ex pats.
