surely he is either suing Souness or not suing Souness? At the moment it as a non story to report that he is thinking about suing Souness - you either do it or do not do it carlos and when you issue the writ it is a story, until that time it is just the weird meanderings of a sadly misguided mind

No: It's only classed as fair comment if it is demonstrably true. The fact is that, after a thorough investigation, the Club could not charge Tevez with refusing to play. Not one of the coaching or playing staff supported that charge.
This being the case, Souness had the ground cut right out from under him, since he had attacked Tevez' character publicly without any proof. He was rash to say the least and if he ends up paying the price for it, I would lose no sleep over that.

As regards the comments on this thread re. free speech, none of us have the right to slander, libel or defame anyone; that's where free speech ends.
Tevez' behaviour has, from what I know, been poor and he had no right to refuse to warm up, but, like the rest of us, he is entitled to the protection of the law of the country.
 
As far as I'm concerned refusing to warm up is the same as refusing to play. But in case the court is any doubt they could easily cause a witness C.Tevez who admitted that he wasn't in the right frame of mind to play.

Perhaps he could sue himself?
 
If there is any substance to this (which is doubtful), then the ramifications are huge. Sky's business model is built on using sport, and primarily football, to build a subscription base to sell their services. If some mard arse player tries to sue a pundit on Sky for expressing an opinion and wins this presents a huge problem for Sky and for that matter all other sports broadcasters. Therefore Sky will defend this with everything they have got. Kia, if you really think that you can take on the might of News International then please feel free to try but you will probably be ruined by it.

Surely Kia knows this. The phrase "the empty vessel rattles the most" seems very appropriate here. Kia and Tevez are just spouting off in a desperate attempt to regain some credibility and in the process are losing even more.

No, it's not the same thing, because he was prepared to go on the pitch and play. He has claimed that he was and no-one can prove that he wasn't.
As regards his supposed statement the next day; had that been provable, then surely the Club would have had grounds to charge him with refusing to play but, as we know, they didn't do that. I'm quite sure that if they could have, they would have.
