Maybe, but if we have irrefutable evidence and UEFA have not followed the appropriate processes I think they would be the losers. There is little love for UEFA in the press.

If we win uefa are the losers anyway. No need to play this out in the media, if we win I'm sure we'll get our story out. CAS will also release it's findings..

Bit off tangent here but I keep thinking about "in the first instance" can't make my mind up if it's a threat, or if we are going after them even if we win.

I interpreted "in the first instance" as we will go as far as we can to clear our name and that meant to a higher authority than UEFA or CAS.
Edited to say, if we go to court then everything we know will be submitted and I would not think UEFA would enjoy that, the G15 might as they would relish UEFA losing. My view is UEFA are between a rock and a hard place, not the best position to put your balls.
 
I too wondered if this would be seen negatively. I'm not sure of the timescale between when we were informed of the charge and the 5 year deadline but we are, of course, entitled to spend adequate time collecting the required evidence to defend ourselves. The greater the charged offence, the greater our need. Retrospectively, as 2 years is a huge ban, surely we were entitled to spend significant time in compiling our defence and we can't have been expected to rush things through because UEFA were getting too close to the deadline.
They charged us on the last possible day up until that point we do not have to provide anything as until we are charged we are not deemed to have done anything wrong

I do not think we are to be honest. There is no doubt there will be plenty of muck out there on UEFA but when the dust settles we will still have to work with the organisation.

Imo the belief on here that we might expose them is a bit of wishful thinking. That is not to say we will not win the CAS case but more likely a victory for City will be represented as a case not being proven against us or UEFA not following the correct processes. If we had some serious info I think it would have been used by now as leverage prior to our reputation being dragged through the mud and the two-year suspension.

Also I am not convinced CAS would be the right stage to throw out any info we have against them, as I would imagine there remit will be to comment on our case and that is all.
 
If we introduce evidence at CAS it will not be bound by confidentiality clauses. The idea that it would be is quite frankly beyond stupid

Just because certain facts are presented in a confidential court case - does not in itself make those facts confidential.

As far as I’m aware - justice is not time bound. If we’ve been accused of something- which we have - I’d expect the CAS to thoroughly examine all the relevant facts including our defence, regardless of whether the IC or the AC bothered themselves with such trivia!

It is a bit strange, as there is nowhere else to take the case brought as far as I know.
Any Swiss Court action would be on broader grounds than the particular charges, as far as I can tell.
