Just to be clear, the problem isn't with how much the deals were for, it's who paid the money?
 
I’m pretty sure the wording of both statements put out by the club this week, are not words of an organisation, contemplating going to CAS.



Manchester City FC is fully cooperating in good faith with the CFCB IC’s ongoing investigation. In doing so the Club is reliant on both the CFCB IC’s independence and commitment to due process; and on UEFA’s commitment of the 7th of March that it “….will make no further comment on the matter while the investigation is ongoing”.

The New York Times report citing “people familiar with the case” is therefore extremely concerning. The implications are that either Manchester City’s good faith in the CFCB IC is misplaced or the CFCB IC process is being misrepresented by individuals intent on damaging the Club’s reputation and its commercial interests. Or both.

Manchester City’s published accounts are full and complete and a matter of legal and regulatory record. The accusations of financial irregularities are entirely false, and comprehensive proof of this fact has been provided to the CFCB IC.

And,


“Manchester City Football Club is disappointed, but regrettably not surprised, by the sudden announcement of the referral to be made by the CFCB IC Chief Investigator Yves Leterme.

“The leaks to media over the last week are indicative of the process that has been overseen by Mr. Leterme.

“Manchester City is entirely confident of a positive outcome when the matter is considered by an independent judicial body.
The accusation of financial irregularities remains entirely false and the CFCB IC referral ignores a comprehensive body of irrefutable evidence provided by Manchester City FC to the Chamber.
The decision contains mistakes, misinterpretations and confusions fundamentally borne out of a basic lack of due process and there remain significant unresolved matters raised by Manchester City FC as part of what the club has found to be a wholly unsatisfactory, curtailed, and hostile process.


These are the words of a multi billion pound organisation, who are willing to protect their interests, and the interests of partners/sponsors, through the highest courts in the land.

Manchester City, I hope, are on the warpath and ready to rain misery, fear and hardship, into the very hearts of those who have dragged the good name of our club to the gutter.

Come on City!
 
Does anyone know how stolen emails would stand up in court?

Or would a judge simply dismiss any evidence than was obtained by theft?
Best bet is probably print them off, then use a form of origami and you should get a reasonably solid structure. ; )
 
If UEFA try to ban the club after having ignored cast iron proof of Citys innocence, but fail in a proper court, do they open themselves up to civil legal action for damage to reputation etc.?

That's the only way I see this ending with a win for the club. They have to stop the ban, then go above and beyond to have UEFA publicly shamed for it.

Outside of that, no one will ever believe Cuty were innocent, it will just be assumed there was a backroom deal or bribe, or city got through on a technicality.

They will go to CAS first though.
 
Surely all that has happened is that the Investigatory commitee (IC) has passed the matter to the adjudicatory committee (AC), which is the process? That HAD to happen, regardless of the outcome, and it's now known what the recommendations actually are. The UEFA statement is entirely neutral in tone, and simply tells the world where the process has got to.

I think you're right about the difficult position UEFA are in regarding possibly ending up in court though, and that may take a while for them to work out (and probably talk to City about).
Not it didn’t have to happen. If the IC found no wrong doing or recommended punishment of 100k euros or less, they didn’t have to bump it on to the AC at all.
 
Looks like City are preparing to take the gloves off, as Tolmie alluded earlier in the week.
I assume some very expensive lawyers are going to unload both barrels on UEFA.
