Trump and his cult members are claiming he can say and think whatever he wants about the election — it was stolen, rigged, a do-over is needed, etc. That’s not what the case is about — and the indictment recogniz(s)es Trump’s right to say and think those things — but about what he he told/asked/ordered others to do. That’s the “conspiracy”.

Now he wants to argue that asking others to commit crimes is protected speech as well. And the Supreme Court already ruled in 2008 that it isn’t. Again, it’s the asking that’s the conspiracy. You can’t ask someone to commit a crime — like, say, election fraud. That’s illegal. And not protected speech under the First Amendment. So saying it is free speech won’t work as a defense either.

And I doubt very much even this Supreme Court would overturn that 2008 decision (US vs Williams) if it came to that (which it may, knowing Trump). It was decided 7-2 with the opinion written by the most conservative justice on the bench, Antonin Scalia.
Simply put it's about actions not words
 
It’s even worse than that: he doesn’t even need a pardon to become president from prison, nor resign to have himself pardoned so he can govern freely, as there is no law against an incarcerated person being elected to the highest office in the land and no constitutional test of a President pardoning himself. If he pardoned himself the Supreme Court would most certainly get involved to interpret what the founding fathers intended… and we know how that has gone with these idiotically crazy originalists he installed.

I was just assuming that he wouldn't spend any time in prison if he could avoid it. So wouldn't wait for a supreme court decision. Seeking power has always been about his own self interest he's not going to stay in prison when he can click a switch and leave.

So it would either be pardon or getting rogue elements of the military/law enforcement to bust him out the front door.
 
The DOJ has asked District Court Judge Tanya Chutkan to issue a protective order after Trump posted, "If you go after me, I'm coming after you!" on his social media platform.

I expect that the protective order will be granted. I doubt though that Trump has enough self control to comply with such an order. Might Trump force the court to place him in jail?
Amount of money he is raising to pay his legal bills and support he is getting from the loons over there, he may be risk it.
Then again his elaborate combover and bloody spray tan regime would be affected so maybe not

To pardon himself he would have to accept responsibility for the crime though. Owning wrongdoing is not something he does

Apparently he can pardon himself preemptive to prosecution. At least that’s what Nixon’s lawyers thought when they researched the issue 50 years ago. I know — nuts, right? I agree with you that he’ll never own it. Which is why I wonder if he’d ever accept a plea deal that included never running for office again. That said, he’s settled lawsuit after lawsuit, so like all bullies there is a point where he will break down and cower.

I wonder if he’d ever accept a plea deal that included giving up US citizenship (as easy as dropping off your passport on an overseas US embassy).

Would solve a lot of problems since:
