No one is denying anyone the right to education though are they .... we are simply saying that they should have a choice ... if they choose Private education then they pay the correct level of taxation .

Exactly this. State school is there for everyone. If a family want to give their children a private education instead, then pay what is due
 
The argument will be specific government policy may deny the right to access a pre existing school thus is incompatible with A2 of ECHR. It’s strange in the sense that right is only given to those who can afford it but the right for private schools to exist is guaranteed under ECHR - for the 93% it guarantees the right to an effective education.

The key is pre existing and the governments defence would have to be that VAT does not present a risk to any existing school which I can’t see how they can successfully argue that.

I guess we will get a sense of how the government really feels about the policy and the strength of their case when it gets to the High Court. I’d not be surprised if the government withdraws at that point which would tell us they had no real belief in it.
Fuck me, relying on legal loopholes to protect the right of public school privilege and to suppress the clear will of the people as expressed in one of the biggest majorities in modern UK history.

Surely all those leftie lawyers will refuse to work on this case.
 
expect a lot of this as changes roll out - there will be no increase in pensioners dying from the cold - the rich will not skeddadle - just those who are happy with the status quo or scared of change are really, really spooked by the idea Labour may make things a bit better for people whilst they try to defend Jnerick or Badenoch
