CAS judgement: UEFA ban overturned, City exonerated (report out p603)

anything from a hacker like stolen emails are useless in a court of law ? because if it can be stolen it also can be planted and changed. this is why manchester city have 100% power because we can prove it to be fake

also the time bar is key to why uefa lost the case. they forget the rules and city people had them over a barrel
plus the biggest thing of all was we did nothing wrong and we proved it. i think the reason why we had a fine of £10million was because we failed to work with uefa and the paperwork was being held by the club
the club had good reason to refuse to co-operate , everything previously given to UEFA was being leaked with the help of insiders like Gill ,UEFA are crooks , its been proven time and again , we took the £10m fine and laughed in their faces , its a drop in the ocean. No doubt the Premier league will do the same , another paltry fine to appease the other 19 clubs , personally i wouldnt give them a bean and spend the next decade in the courtrooms , the Premier league's money will run out before ours.

Following the UEFA leaks to the press, UEFA's ethics committee was investigating said leaks (If you remember, following our acquittal, Parry swiftly left UEFA)
I've attempted searches to see if they'd reached any conclusions but I've had no success

@Prestwich_Blue do you know of anything more?

Doesn't matter what was leaked. We aren't being charged with being hacked. The crux of the matter is whether or not our accounts are accurate as far as i can tell.

This is why the accusations of cheating are so frustrating to me. Our wins and titles are from the coaches and players. As far as i know we've paid everyones wages and don't owe transfer fees. What is the actual problem?

The established elite don’t like it up ‘em.

Not least because the emails published in the Mail (the so-called new evidence) are discussions relating to our accounts in 2010/11....three years before the PL had even implemented their version of the FFP regulations. The phrase "red herring" doesn't do it justice.
I think today's articles in the Mail actually read like a contrived retraction of last week's absurd stories. Certainly no other news media has given any credence to these re-heated 10-year-old documents from Nick Harris. The PL can only be looking for a way to drop this embarrassing and ill-conceived "investigation."
I'm not paranoid, but even the herrings have red shirts. They're all out to get us!

;-)

Wasn’t the Der Spiegel one fake anyway? I think it was a chain of emails that had been made into one?

My heart sinks when I see this thread near the most recently read (he says making a new point!). I wonder what trumped up charge I will read about. What hypocrisy will I see as Liverpool and Utd and their lackeys lead this witch-hunt. Thank goodness we have City fans who stand up to these media shrills. If this was one of the “Heritage” clubs this nonsense would have stopped long ago. I don’t know why the club doesn’t make a bigger stance but then again I suppose why give the individuals in question the publicity they want.
It’s also not cheap to hire expensive top level lawyers to deal with legal matters. Not sure what legal cause of action or theory could be used to stop it either. These are investigations by bodies that we choose to be involved with by playing in their competitions. They are entitled to investigate whatever they want.

Our majority owner is an Arab Muslim who has made huge investment in his business, that is not allowed, as it shows up the good old, white American ownership model of little or no investment , then take out huge capital out of the business.

Our club, and a club like Leicester should be the model of how to run a successful modern day football club, superb investment at all levels of the business, investment in the local community and making the business self funding and profitable after the initial investments.

I emailed Ceferin asking for a progress report. No reply.

A quick point re the time bar.
There were two items ruled out by the time bar. Our defence to one of them would have relied on our audited accounts, which defence worked in every other charge.
On the second item CAS specifically said (I paraphrase) that there was no evidence that the purported action took place after ffp had been introduced.
Thus, journos saying we got off on a technicality are plain wrong in assuming we would have lost in those instances had they been litigated.
Henry Winter claimed they were only time barred by City's delaying tactics. Wrong on two counts, the most obvious of which is that the clock stops running on the day Uefa lay a complaint. I emailed Winter on this point and he could not grasp it.

So the gist i’m getting is

The PL have a couple of new emails which may grab a headline but don’t contain a lot.

The rest of the PL clubs (who are shareholders tbf) are pushing the PL to investigate/punish City.

City are prepared to fight an attritional litigation case to wear down the PL’s legal funding and potentially time bar some of the accusations from being charged.

The PL’s investigation/disciplinary panel never get’s involved in anything like this it’s usually player suspensions.

If it does get to a full and final hearing, City will fall back on all the evidence they had at CAS, auditted accounts, sworn witness statements etc.

Extremely high bar for PL to prove guilt given the above, UEFA got nowhere near it.

Potential fine for non compliance to save face.
Doesn't matter how long the case runs, the clock has stopped running.
You cannot create a time bar by eeking out proceedings.

But yet they choose to always investigate City

I’m no legal expert but as I understand it the clock keeps running until such time as a body levies a charge against the club (in this case, the PL or the FA).

Neither has done so as of this morning so the clock very much IS still running. (As I understand it, I could of course be hopelessly wrong)

No, you are entirely correct. Limitation is 6 years in the UK. If they leveled the charge today it would only be for issues after August 1 2015.

I've checked the UEFA website page that details ongoing and completed investigations. Can't see any evidence that an investigation was ever formally opened.

It'd be hard to progress something that never existed in the first place.

Surely we don’t know whether any formal charges have been laid or not? Clearly some kind of process is ongoing.

Possible that charges have not been laid, but unlikely. Otherwise why would we be in court? Even if the current hearings are about procedural matters, it would be odd to argue against a procedure without knowing what the issue was in the substantive case.

When you're in a swamp you stay still and don't thrash around or you go under.

Manchester City deliberately chose not to engage these journalists because they are not fair-minded. They are not prone to rational discussion. You are making a mistake in engaging them. Whatever we say or do, we are owned by an Emirati and we will be subject to attack.

Wow, 'respected' journalist fails to understand the simplest aspect of procedure when it's explained to him in words of one syllable ..... well colour me shocked!
