This causes a few arguments ! If I am driving in the left hand lane for a few miles i pass them on the inside.
In my eyes I am not undertaking as I havent moved into the lane to undertake.

I have asked a few driving instructors and they say that's fine but the police say I have to move to the 3rd lane !.

As I understand the highway code as long as I havent moved to the inside lane to undertake it's ok as it's just lanes of traffic moving at a different speed.

I’ve done circles around someone once. They were driving in the middle lane for ages and I overtook them on the right hand lane, moved to the middle, then to the left hand lane and slowed down, let them go ahead of me and then did it again!

That's as maybe and I agree but if the driver in question is stupid enough to stay in the middle lane for miles then there is clearly a problem with the driver, a driver who is daft enough and more than capable enough to pull into the inside lane without checking their left hand mirror. These people are not confidant drivers and usually aren't aware of their surroundings.
