Surely if they are cutting staff numbers, that's just redundancy so normal redundancy procedures should be used.

Employees who do not accept the new contract are dismissed and offered immediate re-engagement on the new terms.
If they do not accept they are dismissed without redundancy pay on the basis that the new contract still constitutes a suitable, reasonable alternative.

If the employer can demonstrate that the changes are essential and a last resort and have consulted etc and that the changes are “reasonable” then they can seek to hire and rehire.So why don't all companies who plan to make redundancies do that?

Asda, British Airways and others in france have used this tactic in previous years while under EU law
Only in Spain and Ireland is it enshrined in the countries own employment laws as far as I am aware.
