CAS judgement: UEFA ban overturned, City exonerated (report out p603)

The email might be time barred, I'm not sure on that respect, but I am sure that if Pearce has perjured himself then the question of the email being time barred becomes irrelevant.
I accept perjury is not time barred but one would imagine a police investigation (maybe) Not 100% sure on any of this the goalposts seem to have a life of their own in respect of City.

What is this 'comfortable satisfaction' burden of proof they use? Surely if a CAS finding means they are accusing one side of breaking criminal law they should use the 'beyond reasonably doubt' burden of proof.

If they are only dealing with civil law cases 'in all probability' applies so where did they find 'comfortable satisfaction' from?

You can almost see the searches they made. - Search all emails from: Simon Pearce to: @etihad.com addresses containing £67.5m OR £8m and go from there. Searches made post the judgment.

and we would of done like wise, certainly as he was a witness, extremely naive if we didn't

The full transcript of any evidence given by our witnesses has not and will never be released
The 94 page report is just that.
Points released by cas with citys and uefa permissions
So to use the report and another stolen email to prove Pearce lied is nonsense
Unless cas open up the evidence transcript and look into it but wouldnt that be for uefa to appeal and ask for it

With CAS allowing the emails to be permissible in court, surely that opens up the potential for all of them to be used in the future.

However, as the CAS judgement states, the emails alone show no evidence of disguised owner investment. I’m sure UEFA would need more evidence than this alone.

City will also be fully aware of this and their legal team will have made sure that the non disclosed leaked emails will not impact the findings of the case.

I see more of these stories being printed over the next week which will be a PR disaster for the club, but I doubt anything will come of it from a CAS/legal perspective.

That said, events over the past week showed that we were never going to change the public perception anyways. It’s best just to ignore it and move on.

UEFA and all the other clubs having a pop at City don’t want to get too involved in the Der Spiegal story. Hacked emails could set an extremely dangerous precedent and we are by no means the only club to have skeletons in the closet.

It’s worrying what they are reporting as it contradicts what Pearce told CAS, he appears on the face of the emails to be directing Etihad on how to pay their sponsorship obligation to City, he told CAS that he had never arranged sponsorship payments. I’d be lying if I said I wasn’t concerned.

Can someone fact check me here and see if I’ve got it wrong?

I process invoices at work, if I’m invoiced incorrectly I go back and ask for a breakdown to my liking - that’s not me arranging the payment, just asking for it to be amended.

I’m not sure he sent all 6mil of them, take my hat off to him if he did
Did I suggest he did? That’s a weird response. I think the issue is that a lot of the less profession emails seem to emanate from Simon. I’m not sure that all 6 million (emails and documents) were potentially damaging, but I don’t think they were so that number is irrelevant. Appreciate your smugness though

He details in length how each payment is to be structured over the coming years and what is owed, he said to CAS he had ‘categorically not’ ever arranged payments from Etihad to the club.
