Ched Evans - serious injury

However, if you believe yourself to be innocent, you'd fight to the end to prove it. At this very moment in time he's just served 2-3 years for an incorrect conviction. Trauma on both sides in this case.

I completely agree - it's just a farcical process to go through.

I read up on this case a lot at the start and remain puzzled as to why Clayton was found innocent but Ched guilty... they weren't drinking at the time so despite being able to consent at first... she was then too intoxicated to have possibly consented the second time around... weird. The trouble for Ched is that they definitely were taking advantage of the girl - she was probably letting them, but it still comes across as a couple of cocky footballers which for a jury immediately makes them critical. The girl sent a text late on that was clear and accurate.

I think he'll get found innocent at a re-trial and will be able to play football again, forever tainted by the events.

As someone else said, he was in great form and would possibly have been playing for Wales in the Euro's this summer...
 
I assume that any payout to Evans (if found not guilty) will depend on the reasons why the 'new evidence' was not available at his original trial. The jury could only decide on the evidence that was presented to them at the time and if that wasn't complete, for whatever reason, its not their responsibility. If there was negligence by the Police or deliberate collusion to ignore or withhold evidence then I guess he's going to be well compensated financially. I'm not sure how it works (with regard to compensation) if the new evidence reveals his accuser has lied about the facts and that has got him convicted.
 
So he's won his appeal against his conviction but has a new trial with the new evidence to decide what his punishment would have been... I suppose even if he's convicted again he's served the time... but that's a hell of a lot of time, money and effort to go through in order to try and get cleared. It's also a hell of a lot of trauma for the girl involved who has to go through it all again.
My thoughts too, although I'd say it's a lot for all parties to go through.

I guess I see why the prosecution would want another trial, but it's not going to come cheap.

That rather depends if there is earth shattering evidence like mistaken identity or a sophisticated blackmail plot. If there isn't them no one will change their mind and he may end up with more antipathy and campaigning against him than he would have had if this had not happened. As it is all under embargo for the retrial I guess no one knows.

I suspect in 5 years time the people who think he is guilty today still will and the people who think he is innocent still will and he will be tarred by the brush far worse because of all the appeals and trials as 10x as many people will be aware and have an opinion.

We shall see when the retrial comes I guess. I must admit though I don't see how any trial can be fair and reasonable now anyway as it seems everyone has an opinion and where they will find a jury that is clean and impartial I don't know.
