Ched Evans - serious injury

Expecting ched to be acquitted..can he claim loss of earnings if so?

Depends. If, post-acquittal, he can prove he's definitely innocent, then yes. If the relevant board takes the view that he might have done it but he's been acquitted because the prosecution didn't prove the case beyond a reasonable doubt, then he won't get any compensation. The fact that the Court of Appeal ordered a retrial, despite knowing all the evidence from the first trial and the new evidence on he basis of which they granted him a retrial, might seem to suggest that the appeal judges didn't think it's a foregone conclusion that he didn't commit the offence. However, time will tell.

Seems that the new evidence, or at least some of it, relates to the alleged victim's sexual behaviour on other occasions. As far as I understand (though I'm not a specialist in this area), this kind of evdence isn't usually considered admissible but it can be in certain circumstances. In this case, the defence seems to be seeking to prove a pattern of similar behaviour around the time of the offence.
