It sets no precedent to the courts and is private anyway. It could theoretically set an authority for future PL arbitrations but probably not.

If the parties wanted a court hearing, an appeal or a ratification, they would have legislated for it in the rules. They didn't, so it is tough. Except in the limited routes prescribed in the agreed rules. But excluding s69 makes it almost impossible for a substantive appeal out of the arbitration route.

Parties can decide the jurisdiction and substantive law that will govern a dispute. They can also agree on many aspects of the arbitration process, including appointing arbitrators, determining procedural rules etc. This is what the PL and the clubs do in the PL rules.

The Arbitration Act 1996 provides a legal framework and supports the autonomy of the parties in agreeing to arbitration terms.

So, leagues don't have to comply with "UK" law, the parties can decide.

The PL is governed pursuant to English law (including the ARBITRATION Act ie the parties agree to arbitrate disputes - usually privately - as an alternative to court), the Scottish Premier League rules are subject to Scottish law and the UEFA rules generally to Swiss law and with permitted appeals to CAS (which the PL also opts out of or doesn't opt into to be more precise).

So the PL's arbitration panel will decide the APT case.

Just got the end of his piece on man utd interesting that he mentioned ( which someone posted similar about the rags on a thread a while back can’t remember which) That they had an exceptional Covid break with regards PSR which no other club had,otherwise they would have failed..This suggests what City have been hinting that certain clubs are getting preferential treatment..

I get the impression after reading and listening to a lot of people who actually know what they are talking about, that the PL arbitration are the final say, unless they make accusations that are just nowhere near true. IE we dont have remit for an appeal to a higher body unless, for example, the PL announce City have been defrauding HMRC but isnt true.

It all makes me think there will be a halfway house, we get punished a bit and the PL dont go too far with their accusation stuff.
