Chris in London....I've had a solicitor mate,£205 per hour....and they will not take on the csa,trust me...what the csa say,goes,believe it or not...they are a law unto themselves.

If you have a court order laying out the conditions for the mortgage then it will specify your payments. If it does and it equals the amount you've been paying then the CSA are right.

I hate the fucking CSA believe me. They have no mercy and the system is not fair but it's the system and the only way to avoid it is to leave the country ;-)

The csa ain't interested in the clean break order,or what the house is worth.......they want you to pay 22% of your income...they don't give a fuck if you can't put a roof over your kids heads...it's just pay,pay,pay.....which I've never not done..and paid more than I should of,and now they want me to pay it all again...

I massively over paid my ex before I got some proper advice but when the CSA got involved they didn't give a shit. As I said. the only way to avoid them once they get a sniff is to leave the country. Since I did that I've been able to negotiate appropriate voluntary payments without their interference.

You are right pal, two of my kids live with me from a previous relationship, my wife and I receive the princely sum of £5 per week towards their upkeep because my ex is a dosser on benefits.

Feel for you mate been through all the shit with them myself over the past year or so. My advice to you would be record everything, everything you buy/pay for or contribute to with receipts etc. don't give up or let her get the better of you.

This, but don't get physical , get her to react publicly and take her to court. Explain to your child that you love her and nothing is her fault. If you can't legally beat the CSA, beat her (legally).
 
The CSA..... The fucking CSA!

1. Write everything down when you speak to them, get full names of the people you speak to and try to speak to "team leaders" only.
2. Ask them to follow every conversation up in writing within 5 days. Otherwise they "miss" things off their notes that they tell you.
3. On a monthly basis demand to be sent all notes relating to your case.
4. Practise not losing your temper - They are c**ts on the phone but the second you are rude they cut the call off and when you complain about this there shall be no record of the call ever happening.
5. If calling from a smart phone I would advise you to record the call, you have to tell them that you are doing so but since I have done this suddenly they aren't such c**ts.
6. Be ready for them to make a deductions of earnings. Legally they have to inform you and send you a copy if such order, they won't. But they will insist they did when they take 40% of your net income and you ring up kicking off.
7. Doesn't matter if you are in the right or in the wrong, they do as they fucking please and get away with it.
8. Leave Europe. from my research they can still with the help of the EU enforce orders on you if you are still within the EU, not sure if other countries actually enforce them though.
9. Keep records of everything.
10. Do not disclose any data or info on your current partner. They have no right to ask for such information but they do.
11. In the first letter you write to them state your reasonable timescale to replying to their letters. They have a habit of sending you letters dated 6 days prior to when they are actually put through your letter box and in the context of these letters you shall find they want x y and z returned with 7 days of the date of letter. This proves a challenge when you may work away, have a weekend break etc.
12. Insist that all post is sent to you recorded. I have had a few nasty letters because I didn't reply to a letter they allegedly sent, they may well of sent it but I never received it.
13. Everything you send - Recorded delivery.
14. Get a file and have a system of keeping all letters, records of calls and proof of postage slips.
15. Give up and pay........

....... They don't give up, they don't listen, they don't give a toss if you have other kids at home, they don't give a toss that you have bills to pay, they don't give a shit if taking 40% of your net income without prior warning leaves you in a position were you cannot get to work, they will ask you to get credit to pay your "debt" to them, they will not give you any straight answers, you will get letters saying you owe £xx and then another stating another amount.

Good luck - it is a long and hard fight you have ahead of you.
