Fifa vice-president Jim Boyce believes Manchester City should terminate the contract of Carlos Tevez after Roberto Mancini claimed the Argentina striker refused to come on as a substitute against Bayern Munich.

I haven't read through all of this thread as I don't have a spare day, so sorry if this has bben addresed previously.

In making the statements he did after last night's match, I'm pretty sure Mancini effectively sacked Tevez on the spot.

Now regardless of the moral rights and wrongs of that, from a legal point of view I'm prety sure he has given Tevez grounds to sue the club.

The outcome of any internal process may well have been that Tevez was sacked anyway but by pre -empting that process, hasn't Mancini denied Tevez a fair Hearing and as such unfairly dismissed him?

You worry too much, he can't sack him only the club can also you need to listen to what he actually said, also how can you "effectively sack someone"?

The outcome will be that you will never see him in a City shirt again and he will be out of the club come January

Mancini as the manager said in public that Tevez will never play for him again. That's a breach of trust and confidence which forms the basis of the employment contract. He may, on the face of it, have had good reason in whch case I think its called a "repudiatory breach" - Tevez having broken the contract first by refusing to play.

This is the man refusing to work and the boss sacking him argument. Man breaks contract first and boss retaliates in turn. But, Was Mancini responding to the obvious or should he have looked into matters further before issuing his sacking speech? Legally, I think Mancini badlymessed up, because he wasn't the one who spoke directly to Tevez. He acted according to what others told him. He should have said nothing until an internal enquiry was completed.

A maneger tells a player to get on the pitch and the player refuses, those are the facts, why would you need an enquiry after that? Seems a pretty straight forward case to me.

The only one who has messed up is Tevez.

Tevez "no" meaning no am already warmed up
Rm "what do you mean no you won't go on"
And in the heat of the moment rm flipped as He saw this as a challenge to his authority

Just to add I fully back rm , or is this just teveZ putting a spin on it

Italian and spanish is so similar that this is just wrong.

it may be problematic what Mancini said but then again he is not his employer and he backed himself up with "I don't decide about that and if it is going to be my way, he is out"

So I doubt it could be successfully used on court.. Mancini should be careful what he is talking publicly though

Maybe we can cut a deal with EUFA's financial fair play division if it's so important to the whole of football.

Hi All,

I'm a West Ham fan and like the Liverpool fan earlier feel so strongly about this that I wanted to come on and offer my full support to your club.

Obviously as a West Ham fan I really like Tevez (Ducks for cover), but what he has done is absolutely disgusting and he is a disgrace to himself and football. West Ham are a very similar club to City, and I, as many of your fans work hard to earn money to watch my club, and if given the chance I would pay 200 grand to play in a Champions League match against Bayern Munich let alone get paid to play!

I have no doubt that the Man City fans will show what a great club they are after all the bad press that Tevez has brought to the club and show their full support to Mancini at the next home game.

I can't wait to see Mancini's face when every City fan sings his name at the next home game and show pampered millionaire footballers that they can't do what they fucking want........ not at our clubs anyway!

If this was a misunderstanding (which it isn't) why didn't Tevez explain himself to Mancini to say no you've got it wrong I meant that I have already warmed up and am ready to go on.? If it was a misunderstanding he would be straight over to Mancini to explain and get out there on the pitch.
