Every single transfer conducted starts with contact to the player via the club or an agent asking him if he would be interested in joining, anyone who thinks that a club goes to all the trouble of launching a campaign of scouting and putting in an official bid before talking to a player is deluded.

It's yet another part of the EFC/Moyes medial campaign to take the heat off them and to place it on us.

Everton's claim will be that we contacted Lescott (directly or indirectly) regarding the details of the contract on offer before Everton gave us permission to do so. That, of course, will be entirely true. Proving it will be a completely different matter though.
You are right to draw a distinction between the public annoucements by each club and its officials, and any private contact between City and Lescott which is almost by definition unknown.

It seems to me that the self-defeating inflammatory conduct of Moyes in regards to City and his own player owed more to conflict with his own board than anything else.
