Garage mechanic crashed my car! Advice needed.

I wouldn't dick about with cheques or bankers drafts etc! It's 2016 he can transfer cash into your bank account in about 20mins if he wants. I'd want the list price for the car by the end of the day or it's insuarnace all the way (and a load of hassle).
 
If both you and he want a swift conclusion to this, find a similar car at a nearby dealer, explain your situation to them, let them ring the mechanic and ask him to transfer the funds.
It depends how badly you need a car really.
 
You have to notify your insurance company, regardless of who was driving, whenever your car has been in an accident. It might be that other people or property were involved so you absolutely need to ensure you're covered.

Road Risk policies I'm pretty sure are all named driver. The driver wouldn't necessarily be on the certificate but the insurer would have to have known about them and accepted them as a risk.
 
I think thats where the problem is PB.
I worked in a garage when I was 17-18. The trade iinsurance then was any driver with a licence. You could put the trade plates on and take it out for a check. Some policies state over 25's now to minimise risk. This mechanics policy doesn't sound like a trade policy. If it's just him and his family, it's seems like a policy any of us could have.
 
As previously mentioned threaten them with the DVSA or actually report them to the DVSA. They can revoke his MOT licence.
I had this problem with a car that got hit whilst having an MOT. The garage said it wasnt their responsibility, until I threatened them with the DVSA and they payed up immediately.
 
The insurance certificate he eventually gave me a copy of, only states that he, his wife and 3 children can drive vehicles related to his business. When I questioned this (as he told me his mechanic crashed the car), he lost the plot and ranted that I know nothing about trade policies. The certificate is quite clear that only 5 people are covered to drive vehicles relating to his business. I've got legal cover and so leaving it to them to look into it. I wish I knew how to post pics, the car is a mess. Both wings, doors, bonnet, front bumper, headlamps and wheels buckled. Brake fluid, oil and water pouring out of it too. It's going to get very complicated this, I can feel it.

That's a lot of momentum to cause that amount of damage and for it to be square on. Your insurers will be able to get some sort of idea if it has been dropped, driven into something , backed into or whatever. Did you notice if any of the ramps / lifts were not being used because they were faulty.

He's already been completely unreasonable and you will probably see your insurance premium go up as a result even if you don't claim or there is no blame attached, even if you have no claims protection.

Looks like he's hiding something, especially if the equipment failed.
If you suspect this Ask for a copy of his latest LOLER inspection for each lift (Lifting Operations and Lifting Equipment Regulations 1998). If that doesn't put the wind up him at least he knows that you mean business, if he hasn't got these he won't want the Health & Safety Police coming round and shutting him down whilst they investigate a suspected breach of regulations.
 
I'd let the insurance sort it out and in the meantime I'd sort him out by referring the weasel to every govt dept or trade body that he has anything to do with at all, the BBC, the MUEN and anyone else I could think of.
From what we've read so far I still wouldn't trust this creep if he gave me cash.
 
OK so I'd be very wary about doing anything not sanctioned (in writing) by the Insurance Company here - the guy is a complete crook who knows he's been caught out and can see he could be out of pocket by far more than £1500 if he's taken to the cleaners by the authorities - on the flip side he could just choose to 'go under' wait a couple of weeks and then start up a 'completely brand new company' with very nearly the same name and pay out nothing, but in that case the Insurance Company is still liable for the write off amount of your vehicle - a £1500 for a 13 year old Civic seems about right, you can get them off the trade for about two grand
