He shouldn't be banned because the ref saw it.But the ref might decide he didn't see it which is what happened with the Mario incident in the Spurs home game. Of course he saw it but he decided it warranted a red when he saw it after the game so he lied and said he didn't see it.
Maybe Aguero will be lucky and get away with it but I wouldn't put money on it.

Yes but again that doesn't even matter. If he was looking in their direction then there can't be retropective action. He's seen the incedent. Saw nothing wrong with it(poor decision on his part). That's the end of it.
