This seems so blindingly obvious that you'd think Messi's camp knows whether they're in the right or not here? It's quite cut and dry. Date - Barca win. No date - Messi wins. Surely any lawyer advising him would know this too, so why would he have gone so strong if he wasn't certain?
Have you not had any info regarding Messi? You usually have a bit of ITK news regarding transfers.
 
It sounds right that he'd probably win but the hard truths are

- he needs a resolution more quickly than Barcelona because he has 2 maybe 3 seasons left in his legs at the top
- Barcelona's threat to take legal action will scare off City based on the size of the risk.

I think they are threatening legal action as a negotiating stance to get a transfer fee. I think they are trying to get him to escalate the situation (refusing to play) to win a PR battle with Barcelona members.

Whatever the rights or wrongs of the legal specifics they have leverage.

If Messi’s contract is “cast iron” up, then Barcelona will lose in court.
Can Barcelona take the risk of losing the player, losing the court case and then having to pay costs.
Plus compensation for loss of earnings whilst it is dragged through the courts.

Barca: No, that clause doesn't exist anymore

Messi: I'm off, my contract allows it
Barca: No, you've a release clause of €700m

Messi: I'm off, my contract allows it
Barca: No, sit down and let's talk about a new contract

Messi: I'm off, my contract allows it
Barca: *the number you are trying to reach is unavailable*

I know whose story I'm believing.
