There is a clause I've read about that states if a senior player who is fully fit is not played even though available after a period of time he gets to leave on a free.

I want to specifically address this as it's important.

There is a FIFA ruling known as Article 15 that states that any player who has not appeared in 10% of the games that he is eligible for has the option to walk in a summer transfer period.

This 10% though, is taken over the lifespan of his contract. Tevez will hit nowhere near this even if he doesn't play for City ever again.

The much more pressing concern from us is the Webster Ruling, which says that any player under 28 who has a contract signed more than 3 years ago will be eligible to leave for a small compensation dependent on future wages/earnings. If my timing is right, he SHOULD be able to take advantage of this in the summer shouldn't he? If we take his wages at £200k per week and he'll have two years on his deal, it will only personally cost him £21 million to buy his contract out.

:)

Indeed. The £21M (or whateever it is) would no doubt be re-imbursed by his new club. This is what tends to put a ceiling on his price since it is that compensation plus the playing time he can manage(when fit) between now and summer.

If he apologized to Bobby and the rest of the team, i'd have him back for the rest of this season. We're in a fantastic position in the league. It would probably benefit both parties. Then fuck him off in the summer when we could get more money for him.
I'd much rather sell him now though but if nobody is going to offer what we want then so be it.

There's more chance of me playing for City than Tevez whilst Mancini is the manager.

I know mate. Just say we had a couple of injuries that left us with 1 striker. What should we do then?

I liked the bit when he was asked if he was being paid when he went back to argentina and he said "no, carlos is not the type to want to be paid if he's not playing, he could have stayed to train with the reserves and be paid but he's not like that". How very noble of him!.

PMSL at this.

He was fined 6 weeks wages in december for not turning up since early November, and he appealed against that to a panel of directors. They dismissed his appeal earlier this month, as Khaldoon said the other day.

Why appeal if he didn't want paying?

Or did he appeal by accident?

Yes Exactly.

An established professional who has, in the course of the season,
appeared in fewer than ten per cent of the official matches in which
his club has been involved may terminate his contract prematurely
on the ground of sporting just cause.
Due consideration shall be
given to the player’s circumstances in the appraisal of such cases. The
existence of a sporting just cause shall be established on a caseby-
case basis. In such a case, sporting sanctions shall not be imposed,
though compensation may be payable. A professional may only
terminate his contract on this basis in the 15 days following the last
offi cial match of the season of the club with which he is registered.

“For two years he was dedicated to the football club, he even went to Italy to get massive treatment on his knee to come back and play in the FA Cup final"

Must admit, if he did play again and we all showed him the disregard and lack of respect he showed us (ie booing him/singing about him being a twat, not that we shouldnt), id be wary and worried thatd he react again like a twat and just stand there on the pitch or something doing fuck all in another jeopardy attempt.

The most important part is the little bit I highlighted. There is no way he can or will be successful with that ruling were he to attempt it, through his own doing he has been unavailable for a large part of the season, thus negating the 10% rule.

In what parallel universe could it be considered 'just' for Tevez to walk away from his contract after Munich and after fucking off to Argentina in November?

Bridge has got sporting just cause, because Mancini hasn't played him despite him being willing and able. (If only he was willing to go.) It isn't because he has done anything wrong that Bridge isn't being played, it's because Mancini doesn't rate him. Fair enough: if the manager doesn't fancy you, you can use this clause to cancel your contract and seek a deal elsewhere.

There is fuck all chance of Tevez successfully cancelling his contract on the basis of 'sporting just cause'. He refused to play. He refused to train. He refused to keep himself fit. He fucked off without permission to Argentina and he hasn't come back.

How could it possibly be 'just' - ie involve 'justice' - to allow him to terminate his contract because of HIS appalling conduct?
