The hacker himself is in custody, I believe. But apparently publishing doctored emails as the truth or basing an entire campaign to destroy someone's club on them isn't illegal.

I think he’s been released on a tag but is restricted to his home. I think he’d been incarcerated for so long they were mandated to grant him vail pending trial, or possibly because he’s started co-operating.
