LolAs I stated, "as a result of a homeowner actively defending their property". I think that was a clear enough line to make your hypothetical situation unnecessary and beneath the level of discussion.

Two men break in and use enough force for the judge to describe it as a terrifying situation and yet he gets prison. The surviving burglar gets a suspended sentence and community service. Some deterrent that.

As to the burglary sentence, on the face of it, it seems light, but probably a reflection of the ordeal he suffered seeing his friend killed. They may have been other circumstances which reduced his sentence too. It’s a myth that burglary sentences are light. There’s a ‘three strike’ rule that’s been in force in England and Wales for over 20 years where three convictions for burglaries of a dwelling mean a minimum sentence of three years. The courts do not take burglaries from people’s homes at all lightly.
They are a fucking horrible thing to endure and people who commit these offences are generally the pond life of the criminal fraternity.
